City of Waterloo - Ordinance Committee met March 27.

Here is the agenda as provided by the Committee:

Meeting called to order at 3:00 pm with the follow committee members in attendance,

Aldermen Clyde Heller, Steve Notheisen, Rita Trantham, James Hopkins, and Russ Row.   City

Attorney Dan Hayes, Aldermen Stan Darter, Zoning Code Administrator Jim Nagel, Mayor Tom

Smith and Finance Officer Shawn Kennedy were also present.  

Agenda Item 1.  Petitions by Citizens on Non‐agenda Items.  None.

Agenda Item 2. Review and approval of 03‐20‐17 Ordinance Committee Meeting minutes.  After

review and discussion, Steve Notheisen noted an addition to agenda item 6.  Addition to

minutes included “Steve Notheisen motion to modify definition title by removing “special

events”.  Minutes corrected.  Motion to approved amended minutes made by Rita Trantham

and seconded by Russ Row.   Minutes approved.

Agenda Item 3.  Special Events.  Shawn Kennedy and Jim Nagel presented information

concerning the need for this addition to Chapter 7, Business Code.  The committee address this

draft ordinance with the following changes/additions:

1. Paragraph 7‐9‐1, Definitions.  Place a period after “public” on line four of definition,

strike remaining verbiage and bullet points.  

2. Paragraph 7‐9‐2 Permits, (B) change “guests” to attendees.  Subparagraph (E) change

“guests” to attendees.  Subparagraph (G)1) change to read “Proof of Liability Insurance

must be provided and, if the event is held on City Property, the City of Waterloo must be

named as an additional insured with Comprehensive General Liability limit of not less

than $1,000,000 combined single limit, each occurrence/ $2,000,000 aggregated.”

The committee then reviewed the Special Event Permit Application form and recommended the

following change:  

In application block D, remove “not applicable” as there could not be a time when not being on city

property would apply if the Special Event Permit Application was filed.

A motion to approve the changes cited was made by Jim Hopkins, seconded by Russ Row, vote 5‐0.

Ordinance will be prepared for consideration by Council.

Agenda Item 4, Mobile Food Vendors.  Jim Nagel and Mayor Smith presented information concerning

Mobile Food Vendor draft ordinance.  The committee worked through the following ordinance

paragraphs and made changes as follows:

Paragraph 7‐9‐1 Definitions.  Food Truck.  Delete “or self‐contained enclosed trailer”, insert “and

registration” after “plate”, delete “prepared”, insert “or non‐alcoholic beverages”, insert “prepared or”.

With the above deletes/insertions, the definition reads:

Food Truck means any self‐contained motorized vehicle with a valid license plate and registration from

which food or nonalcoholic beverages for immediate consumption is prepared or served.  

Food Truck Vendor definition changes:  delete “self‐contained motorized vehicle or a self‐ contained

enclosed trailer with valid license plates and registration.”  Insert “food truck as defined herein”.  With

the above deletes/inserts, the definition reads:

Food Truck Vendor means a person engaged in the business of selling food or non‐alcoholic beverages

from a food truck as defined herein.

Paragraph 7‐9‐3 Permit Required, (B) Insert “agent or” before “employee” on line one, and insert “or

non‐alcoholic beverages” after “products” on line three of this paragraph.

Paragraph 7‐9‐4 Filing of Application and Fee Provisions (C) Strike “for” in line one.

Paragraph 7‐9‐5 Display of Permit. Insert after in “close proximity” and insert “for public view after

truck.

Paragraph 7‐9‐6 Hours of Operation.  Insert after “the hours of”  “is open to the public”.  Sentence will

read:  Food Truck Vendors may operate up to one hour prior to and up to one hour after the hours of

specific event is open to the public.  

Paragraph 7‐9‐7 Sale of Liquor Prohibited.  Strike “shall be” and replace with “is”.

Paragraph 7‐9‐7, Vehicle Appearance and Maintenance.  Last sentence insert “have the company

name”.    Reads:  Each vehicle shall have the company name affixed to the vehicle and not placed on the

grounds.

Paragraph 7‐9‐8 Peripheral Setup.   (A) Insert “.” After vehicle on line three and delete “or cart”.  Last

sentence, delete “shall be” and insert “is”.

(C). Insert “When streets are not closed” at beginning of first sentence.  Second sentence, delete “or

trailer”.  

Paragraph 7‐9‐10 Permit non‐transferable.  Change sentence to read:  No permit issued for the

operation of a food truck shall be transferable.

After completion of review/changes/ a motion made by Steve Notheisen to approve as modified, second

by Jim Hopkins, vote 4‐1 with Rita Trantham voting no.

Review of Mobile Food Truck Vendor application.  Change the Insurance Liability requirements to

“$2,000,000 aggregate.

Motion made by Steve Notheisen, second by Jim Hopkins to adjourn.  Meeting adjourned at 4:45 pm.
