City of Waterloo Ordinance Committee met Monday, July 16.

Committee meeting called to order by Chairman Clyde Heller, with following attending; Russ Row, Stan Darter, James Hopkins and Steve Notheisen, Mayor Tom Smith, City Attorney Dan Hayes, Tim Birk, Russ Thomas, Jim Trantham, Jim Nagel, Nathan Krebel.
Note for record: Minutes of Joint Planning and Ordinance Committee Meeting, 05-23-18 were approved at the 06-11-18 Utility Meeting.
Agenda Item 1. Petitions by Citizens on Non-Agenda Items. No one attending.
Agenda Item 2. Small Cell Facilities.
City Attorney Dan Hayes and James Nagel presented a read-ahead copy of draft ordinance provided by IML on topic of new Small Wireless Facilities Deployment as approved by State of Illinois with implementation date of August 1, 2018. Discussion focused on attachments provided addressing the architectural design of poles. Tim Birk is working with St. Charles IL and there design. He stated currently companies are providing limited information of strength and capacity for attached small cell equipment. Steve Notheisen questioned how this would be covered if installed on private property as most of ordinance addresses on easement right of way. Jim Trantham addressed damaged poles, who has responsibility for immediate removal. Following discussion and questions, Steve Notheisen motioned to approve draft ordinance, second by Stan Darter, approved 5-0. Item will appear on agenda for full council action. Attachments will be separately studied further to ensure pole design and other questions will be addressed.
Agenda Item 3. Dumpster Permit Applications. Nathan Krebel presented changes needed to Ordinance 29-12-1 (C), addressing time frames for bulk dumpster permits, and locations. Jim Hopkins motioned to accept recommended changes, second by Stan Darter, unanimous approved to recommend for full council action.
Agenda Item 4. Comments.
Jim Nagel distributed synopsis of Senate Bill 1735 on Short Term Rental Act.
Research reflects that after presentation, it was send back to state committee.
Dan Hayes and Jim Nagel will track this as local inquiry exists about our short term rental possibility.
Nathan Krebel spoke on a proposed build out of a proposed business located on North Main and First Street. Due to buildout proposed, question of ADA compliance exists. He is recommending architectural drawings be submitted.
With no further discussion, Stan Darter motioned for adjournment, seconded by Jim Hopkins, unanimous to adjourn at 7:15 pm.
