Pinckneyville City Council met Jan. 18.

ROLL CALL

Mayor Robert L. Spencer called the public hearing of the Pinckneyville City Council to order at 8:00 a.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Sammy D. Peradotta, David M. Stone, William B. Stotlar and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. There was no change to the agenda. Administrative staff present: Billing Clerk Terri Lindner and City Attorney Donald Bigham.

OPEN PUBLIC HEARING

Motion by Commissioner Stone, seconded by Commissioner Peradotta to open the public hearing. On roll call: Commissioners Hicks, Peradotta, Stone, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PUBLIC HEARING

City Attorney Donald Bigham explained that the reason the Option and Lease Agreement between 312 Solar Development, LLC is required to be a Public Hearing is because the lease is a 20-year lease.

Mayor Spencer asked if there were any further questions. Being none, he asked for a vote to close the hearing.

A motion was made by Commissioner Hicks, seconded by Commissioner Stotlar to close the public hearing. On roll call: Commissioners Hicks, Stone, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried. The meeting was adjourned at 8:06 a.m.

SPECIAL COUNCIL MEETING

Mayor Robert L. Spencer called the Special Council Meeting of the Pinckneyville City Council to order at 8:07 a.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Sammy D. Peradotta, David M. Stone, William B. Stotlar and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. There was no change to the agenda. Administrative staff present: Billing Clerk Terri Lindner and City Attorney Donald Bigham.

ORDINANCE O-2019-01 OPTION AND LEASE AGREEMENT WITH 312 SOLAR DEVELOMENT, LLC.

Mayor Spencer presented Ordinance No. O-2019-01, an ordinance to be placed on file to approve an Option and Lease Agreement between 312 Solar Development, LLC and the City of Pinckneyville, Perry County, Illinois. Attorney Don Bigham stated that the Solar Company agreed at the end of the lease that they would restore the property to its original state. He also informed the Commissioner that the farm lease agreement was up this year on the said property and that a 30-day notice is required to terminate the farm lease with the current person leasing the farm ground. Commissioner Stone made the motion to place on file Ordinance No. O-2019-01 with a second from Commissioner Stotlar. On roll call: Commissioners Hicks, Stone, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION R-2019-04 TASK ORDER AGREEMENT FOR ENGINEEING SERVICES WITH HMG, INC.

Commissioner Peradotta presented Resolution No. R-2019-04, a resolution to be placed on file to Authorize the City of Pinckneyville, Perry County, Illinois to enter into a Task Order Agreement for Engineering Services with Henry, Meisenheimer & Gende Inc. Commissioner Peradotta explained that the project includes the grant from ITEP. The project will start at the 4-way stop and continue to library. This project includes street, sidewalk, and curb repairs. Tim Simpson questioned if they were going to be coring the street before the project started. Commissioner Peradotta stated that core samples would be done. Tim Simpson explained that he was sure there was brick under the pavement and if that was the case, in his experience that needed to be removed as well. Commissioner Peradotta stated that it would be up to the engineers. Tim Simpson then told the Commissioners that he had someone knock on his door and ask the questions about putting wind mills up in his home area and if that had anything to do with the solar work that was going to be done. Mayor Spencer stated that it had nothing to do with the solar project and he has no knowledge of any wind mills. Commissioner Peradotta made the motion to place on file Resolution No. R-2019-04 with a second from Commissioner Stone. On roll call: Commissioners Hicks, Stone, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

Commissioner Stotlar made a motion to adjourn the Special Council Meeting, with a second from Commissioner Stone. The meeting was adjourned at 8:20 a.m. On roll call: Commissioners Hicks, Stone, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
