Pinckneyville City Council met Nov. 8.

Here are the minutes provided by the council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Tyson Tanner, Police Chief Kenny Kelley, and Fire Chief Jim Gielow. Due to the COVID-19 Pandemic, the public was invited to attend by social distancing in the lobby area and the Council Chambers of City Hall or by calling in on a conference line. The Pledge of Allegiance was led by Commissioner Cicardi.

PREVIOUS MINUTES

Commissioner Hicks made a motion to approve the minutes of the October 25, 2021, regular council meeting, and the minutes of the November 1, 2021, special meeting. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $1,564,171.21 for the payroll period ending October 2021, up slightly from last year. He stated that the regular hours of 67,117.60 and overtime hours of 1,535.50 were both up slightly from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar added the following invoices to the accounts payable: Interstate Municipal Gas Agency in the amount of $35,429.83; Symetra in the amount of $16,077.60; Kone Elevator in the amount of $403.06; which totaled $51,910.49. Commissioner Stotlar made a motion to approve the accounts payable with the additional three invoices. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi again reminded the public about the cross-connection surveys that were due October 1, 2021, as required by ordinance.

Commissioner Cicardi stated the smoke testing in the area of Fairground Road and County Road was delayed one week. He stated Visu-Sewer of Missouri, LLC, hung notices on doors today on affected houses and will now be doing the smoke testing November 9-10, 2021, in an effort to bring the City into EPA compliance.

Commissioner Peradotta thanked City Utility Department employees Jim Garavaglia and Paul Bardle for emptying trash receptacles on Saturday, October 30th, during the Mardi Gras vendor fair and other events. He then thanked City employees Casey Krone, Administrative Assistant to the Police Department, and Doug Hepp, part-time employee at City Hall, assisted by residents Melissa Mathis and Hayden Hicks, for street clean-up of the parade route after the parade. J&S Mowing of DeSoto provided the street sweeper. He thanked everyone for their efforts to keep the City clean during and after the Mardi Gras festivities.

ORDINANCE NO. O-2021-17 TO ACQUIRE A UTILITY EASEMENT FROM GLEN C. BROKERING AND RENEE C. BROKERING

Commissioner Cicardi presented Ordinance No. O-2021-17, an ordinance placed on file at the October 25, 2021, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to acquire a Utility Easement from Glen C. Brokering and Renee C. Brokering. Commissioner Cicardi made a motion to approve Ordinance No. O-2021-17. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried

REQUEST EMERGENCY APPROVAL TO PURCHASE CONTINUOUS CHLORINE ANALYZER

Commissioner Cicardi presented an emergency approval request to purchase a Hach CLT10 Continuous Chlorine Analyzer with SC200 Output Display from USA Bluebook at a total cost of $5,974.29. Commissioner Cicardi stated replacement was necessary due to EPA regulations. Commissioner Cicardi made a motion to approve the purchase. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2021-48 TO ENTER INTO A TASK ORDER AGREEMENT FOR ENGINEERING SERVICES WITH HENRY, MEISENHEIMER & GENDE, INC.

Commissioner Cicardi introduced Resolution No. R-2021-48, a resolution to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Task Order Agreement for engineering services with Henry, Meisenheimer & Gende, Inc. He stated this is for a topographical survey to improve the spillway at the City Lake. Commissioner Cicardi made a motion to place on file Resolution No. R-2021-48. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2021-49 TO ACCEPT A PROPOSAL FROM HAIER PLUMBING AND HEATING, INC., TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT

Commissioner Cicardi introduced Resolution No. R-2021-49, a resolution to be placed on file, to accept a proposal from Haier Plumbing and Heating, Inc., to furnish materials and to approve the award of a contract for the Illinois Route 154/13 Sidewalk and Draining Improvements Project. Commissioner Cicardi made a motion to place on file Resolution No. R-2021-49. Commissioner Stotlar seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST FROM DAVID HOUSTON TO PROVIDE INFORMATION ON BACKSTOPPERS

Commissioner Hicks introduced David Houston, retired firefighter, to provide information on the BackStoppers organization. He explained that BackStoppers was founded in 1959 and is managed by a 30-person non-compensated Board of Directors with a full-time staff of five. They provide $2.5 million in assistance each year. They have assisted over 170 families, including 70 dependent children, of first responders who have lost their lives or suffered catastrophic injury in the line of duty by providing immediate and ongoing financial support. BackStoppers currently covers 13 counties in Missouri and five counties in Illinois and is considering adding five more counties in each state, including Perry County, Illinois. They are funded 100% by donations, contributions, and fundraising events. There is no monetary commitment from the municipality, they just ask for a letter of support from elected officials and ask them to promote, support, and commit to raise awareness of the organization’s mission.

RESOLUTION NO. R-2021-44 TO APPROVE THE 2022 MOTOR FUEL TAX MAINTENANCE PROGRAM

Commissioner Peradotta presented Resolution No. R-2021-44, a resolution placed on file at the October 25, 2021, regular council meeting, to approve the 2022 Motor Fuel Tax Maintenance Program in the amount of $241,000.00. Commissioner Peradotta made a motion to approve Resolution No. R-2021-44. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST APPROVAL TO PLACE AN ORDER AND PURCHASE A 2022 FORD-F-550 TRUCK FROM VOGLER

Commissioner Peradotta requested approval to place and order and purchase a 2022 Ford F-550 4x4 truck with snow plow and spreader from Vogler at a cost of $74,053.00. Commissioner Peradotta made a motion to approve the request. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2021-45 APPROVING AND AUTHORIZING AN AGREEMENT WITH IPMG FOR SERVICES TO ADMINISTER THE CITY’S HEALTH INSURANCE PLAN AND TO PLACE STOP LOSS INSURANCE COVERAGE

Commissioner Stotlar presented Resolution No. R-2021-45, a resolution of the City of Pinckneyville, Perry County, Illinois, placed on file at the November 1, 2021, special council meeting, approving and authorizing an agreement with IPMG for services to administer the City’s Health Insurance Plan and to place Stop Loss Insurance Coverage. Commissioner Stotlar made a motion to approve Resolution No. R-2021-45. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2021-47 TO AUTHORIZE AND APPROVE AN ADOPTION FORM AS AN ADDENDUM TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS AND THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, THE SOUTHERN AND CENTRAL ILLINOIS LABORERS’ DISTRICT COUNCIL, AND LABORERS’ LOCAL 773

Commissioner Stotlar introduced Resolution No. R-2021-47, a resolution to be placed on file, to authorize and approve an Adoption Form as an Addendum to the Collective Bargaining Agreement between the City of Pinckneyville, Perry County, Illinois, and the Laborers’ International Union of North America, the Southern and Central Illinois Laborers’ District Council, and Laborers’ Local 773. Commissioner Stotlar made a motion to place on file Resolution No. R-2021-47. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2021-46 TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT WITH THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, THE SOUTHERN AND CENTRAL ILLINOIS LABORERS’ DISTRICT COUNCIL, AND LABORERS’ LOCAL 773

Mayor Spencer presented Resolution No. R-2021-46, a resolution placed on file at the November 1, 2021, special council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Collective Bargaining Agreement with the Laborers’ International Union of North America, the Southern and Central Illinois Laborers’ District Council, and Laborers’ Local 773. Commissioner Hicks made a motion to approve Resolution No. R-2021-46. Commissioner Stotlar seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2021-18 TO BORROW FUNDS FROM THE WATER POLLUTION CONTROL

LOAN PROGRAM THROUGH THE ILLINOIS ENVIRONMENTAL PROTECTION AGENCY

Mayor Spencer presented Ordinance No. O-2021-18, an ordinance placed on file at the November 1, 2021, special council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to borrow funds from the Water Pollution Control Loan Program through the Illinois Environmental Protection Agency. Commissioner Cicardi made a motion to approve Ordinance No. O-2021-18. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPROVAL OF EMPLOYEE CHRISTMAS GIFT CERTIFICATES

Mayor Spencer requested approval for Christmas gift certificates in the amount of $30.00 each to all city employees, including volunteer firefighters at a total cost to the City of $2,280.00. Commissioner Peradotta made a motion, seconded by Commissioner Hicks to approve the request. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared

PUBLIC COMMENTS

Commissioner Stotlar, on behalf of the City Council, congratulated Dixie King on 20 years owning Dixie Cup Café and working in the business for over 30 years.

ADJOURNMENT TO EXECUTIVE SESSION

Motion by Commissioner Peradotta, seconded by Commissioner Cicardi to move the meeting to Executive Session at 6:26 p.m. for the discussion of: Section 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee, Section 2 (c) (2) Collective negotiating matters or deliberations concerning salary schedules, and Section 2 (c) (5) Purchase or lease of real property for the use of the public body. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RETURN TO REGULAR MEETING

Motion by Commissioner Peradotta, seconded by Commissioner Cicardi to return to the regular meeting at 6:58 p.m. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2021-19 TO ENTER INTO A LOTS AND LAND SALES CONTRACT FOR PURCHASE OF REAL ESTATE LOCATED AT 407 WEST WATER STREET, PINCKNEYVILLE, ILLINOIS

Mayor Spencer introduced Ordinance No. O-2021-19, a resolution to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Lots and Land Sales Contract for purchase of real estate located at 407 West Water Street, Pinckneyville, Illinois. Commissioner Cicardi made a motion to place on file Ordinance No. O-2021-19. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
