Pinckneyville City Council met April 11.

Here are the minutes provided by the  council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer requested to add Executive Session for the discussion of Section 2 (c) (5) Purchase or lease of real property for the use of the public body. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, and Fire Chief Jim Gielow. Due to the COVID-19 Pandemic, the public was invited to attend by social distancing in the lobby area and the Council Chambers of City Hall. The Pledge of Allegiance was led by Commissioner Hicks.

PREVIOUS MINUTES

Commissioner Peradotta made a motion to approve the minutes of the March 28, 2022, regular council meeting. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $449,356.75 for the payroll period ending March 2022, up from last year due to the increased wages of the Laborer’s Union contract. He stated that the regular hours of 16,220.25 were down from last year and overtime hours of 600 were up from last year primarily in the police and utility departments. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable with one additional invoice: Mayor Spencer’s mileage in the amount of $61.43. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi stated the new names have been added to the Honor/Freedom Memorial at the City Park. The new names engraved are: Holli R. Bolinski, Bernard F. Reynolds, and Tyler R. Iubelt.

Commissioner Cicardi stated O’Reilly’s is awaiting delivery of their shelves and merchandise. They anticipate opening May 21, 2022.

Commissioner Cicardi stated Haier Plumbing hopes to start installing the box culverts for the drainage improvements in the new sidewalk project area soon.

Commissioner Hicks reminded the community that the Firemen’s Association has postponed their annual Good Friday Fish Fry due to the increased price and availability of quality fish not making it feasible to sustain a profit. They hope to resume next year.

Mayor Spencer stated Ameren is upgrading light poles in town and out by the prison as part of their maintenance program. Commissioner Hicks asked about the City Clock not showing the correct time. Commissioner Peradotta said he has been looking for the instruction book. Mayor Spencer said a company had to reset it the last time but, since it is going to be moved when the new highway goes through, not to pursue correcting it at this time.

PUBLIC COMMENTS

Mayor Spencer had City Clerk Melissa Kellerman read two public comments which were e-mailed to her prior to this meeting which are regarding Item #3 on Mayor Spencer’s agenda.

“Over 6 decades ago my Grandfather Albert Eugene Wallace, his brother, Harold, Sr., and nephew, Harold, Jr. drowned at Pinckneyville City Lake. While the details of that day have been buried for about the same amount of time; the wounds from this enormous tragedy still run deep.

On behalf of the Wallace family, we are seeking recognition for the precious lives of our 3 family members that were taken from us to soon, and would be honored to have a plaque in their memory, placed at Pinckneyville City Lake.

“I am the oldest daughter of Gary Wallace, Sr of Sparta. My dad was a 19 yr old, newly arrived soldier to The School of Infrantry, when he received the tragic news about his father, his uncle and his little cousin. Even though I've heard my father speak numerous times of the pride he has being a former Marine and a Wallace, I've never really heard him speak of the pain I'm sure he still feels, from losing the two men he looked up to and cherished while growing up. Due to the profound and inconceivable loss, we rarely heard stories of who these men were but I KNOW from watching my dad, aunts & uncles, that THEIR dad must have been awesome as well. I KNOW that my grandfather and my uncle were GOOD men, hardworking men, lover of their families men and UPSTANDING citizens in their communities. They were small town, country if you will, outdoorsmen who hunted, fished, camped and swam like Olympic champions!

I'd like to thank you in advance for your consideration in honoring our family and the men who's DNA made us who we are; High Divingboard Champions, College Graduates, Medical School Students, Business Owners, Engineers, Educators, Culinary Chefs, Army Veterans, Navy Veterans, Marine Veterans, Police Officers, Accountants, Software Analysts, Senior Citizen Caregivers, Volunteers, Community Advisors, Fathers, Mothers and Grandparents.

HONORARY PLAQUE/SCULPTURE AT CITY LAKE AS A WALLACE MEMORIAL RECOGNIZING TRAGEDY THAT OCCURRED AT CITY LAKE ON JULY 7, 1959

Mayor Spencer stated he has talked to Cari Wallace, and she requested to place an honorary plaque/sculpture at the City Lake as a Wallace Memorial honoring her three family members who tragically lost their lives at the City Lake on July 7, 1959. She has requested to have a memorial at the City Lake on July 7, 2022. Mayor Spencer asked for Council opinions. Commissioner Peradotta stated he was in favor of the request. Commissioner Hicks stated others have died at the lake, but he did remember very well the incident happening when he was six years old. Mayor Spencer said the family would need to pay for the plaque. City Attorney Don Bigham confirmed the family was asking the City to approve the memorial being placed at the City Lake. Mayor Spencer confirmed. Commissioner Cicardi confirmed the family would pay for the plaque. Mayor Spencer confirmed. Commissioner Peradotta stated it should be placed in a location where it would be easy to mow around. Commissioner Peradotta made a motion to approve the request. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-07 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO A CONTRACT WITH CWI OF ILLINOIS, INC. TO ACCEPT AND PROCESS LEACHATE

Commissioner Cicardi introduced Ordinance No. O-2022-07, an ordinance to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a contract with CWI of Illinois, Inc., to accept and process leachate. He stated the previous contract expired in 2021. This contract increased from .0133 to .04 and is a five-year contract. Commissioner Cicardi made a motion to place on file Ordinance No. O-2022-07. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-20, AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO A SWIMMING POOL MANAGEMENT SERVICE AGREEMENT FOR THE MANAGEMENT OF THE CITY POOL

Commissioner Cicardi introduced Resolution No. R-2022-20, a resolution to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a swimming pool management service agreement for the management of the City Pool. Commissioner Cicardi stated this contract has the same terms as the last three years and is with Cheryl Clark. Commissioner Cicardi made a motion to place on file Resolution No. R-2022-20. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCEPT RESIGNATION FROM POLICE OFFICER LUKE MILLER EFFECTIVE MARCH 26, 2022

Commissioner Hicks made a motion to accept the resignation from Full-Time Police Officer Luke Miller effective March 26, 2022. He stated Officer Miller accepted a position with the Illinois State Police. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

FIRETRUCK EMERGENCY REPAIRS FROM MEVERT AUTOMOTIVE & TIRE, INC.

Commissioner Hicks stated a Pinckneyville firetruck and two Rural firetrucks all went down in the same week and had to be fixed. Commissioner made a motion to approve the firetruck emergency repairs from Mevert Automotive & Tire, Inc., at a cost of $3,865.26. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-15 TO ACCEPT A PROPOSAL FROM ILLINI ASPHALT CORPORATION TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT (SURFACE TREATMENT)

Commissioner Peradotta presented Resolution No. R-2022-15, a resolution placed on file at the March 28, 2022, regular council meeting, to accept a proposal from Illini Asphalt Corporation to furnish materials and to approve the award of a contract (surface treatment). Commissioner Peradotta made a motion to approve Resolution No. R-2022-15. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-16 TO ACCEPT A PROPOSAL FROM ILLINI ASPHALT CORPORATION TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT (OIL AND CHIP)

Commissioner Peradotta presented Resolution No. R-2022-16, a resolution placed on file at the March 28, 2022, regular council meeting, to accept a proposal from Illini Asphalt Corporation to furnish materials and to approve the award of a contract (oil and chip). Commissioner Peradotta made a motion to approve Resolution No. R-2022-16. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-17 TO ACCEPT A PROPOSAL FROM BEELMAN READY MIX TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT

Commissioner Peradotta presented Resolution No. R-2022-17, a resolution placed on file at the March 28, 2022, regular council meeting, to accept a proposal from Beelman Ready Mix to furnish materials and to approve the award of a contract. Commissioner Peradotta made a motion to approve Resolution No. R-2022-17. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-18 TO ACCEPT A PROPOSAL FROM BEELMAN READY MIX TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT

Commissioner Peradotta presented Resolution No. R-2022-18, a resolution placed on file at the March 28, 2022, regular council meeting, to accept a proposal from Beelman Ready Mix to furnish materials and to approve the award of a contract. Commissioner Peradotta made a motion to approve Resolution No. R-2022-18. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-19 TO ACCEPT A PROPOSAL BARR TRUCKING, INC., TO FURNISH MATERIALS AND TO APPROVE THE AWARD OF A CONTRACT

Commissioner Peradotta presented Resolution No. R-2022-19, a resolution placed on file at the March 28, 2022, regular council meeting, to accept a proposal from Barr Trucking, Inc., to furnish materials and to approve the award of a contract. Commissioner Peradotta made a motion to approve Resolution No. R-2022-19. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-22, AUTHORIZING PUBLIC HEARING ON THE ANNUAL BUDGET FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS FOR THE YEAR ENDING APRIL 30, 2023

Commissioner Stotlar presented Resolution No. R-2022-22, a resolution authorizing public hearing on the annual budget for the City of Pinckneyville, Perry County, Illinois for the year ending April 30, 2023. Commissioner Stotlar stated the public hearing will be April 25, 2022, at 5:45 p.m., right before the next regular council meeting. Commissioner Stotlar made a motion to approve Resolution No. R-2022-22. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-08 APPROVING THE ESTIMATE OF REVENUES FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, FOR THE FISCAL YEAR ENDING APRIL 30, 2023

Commissioner Stotlar introduced Ordinance No. O-2022-08, an ordinance to be placed on file approving the Estimate of Revenues for the City of Pinckneyville, Perry County, Illinois, for the fiscal year ending April 30, 2023. Commissioner Stotlar made a motion to place on file Ordinance No. O-2022-08. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-09 TO ADOPT THE ANNUAL BUDGET FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS FOR THE FISCAL YEAR ENDING APRIL 30, 2023

Commissioner Stotlar introduced Ordinance No. O-2022-09, an ordinance to be placed on file to adopt the Annual Budget for the City of Pinckneyville, Perry County, Illinois, for the fiscal year ending April 30, 2023. Commissioner Stotlar made a motion to place on file Ordinance No. O-2022-09. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-21, AUTHORIZING A SUBORDINATION AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, AHAC, LLC D/B/A GRECIAN STEAKHOUSE AND FIRST NATIONAL BANK IN PINCKNEYVILLE FOR THE PURPOSE OF SUBORDINATING A MORTGAGE LIEN OF CITY TO THE MORTGAGE LIEN OF FIRST NATIONAL BANK IN PINCKNEYVILLE

Mayor Spencer presented Resolution No. R-2022-21, a resolution authorizing a Subordination Agreement between the City of Pinckneyville, Perry County, Illinois, AHAC, LLC D/B/A Grecian Steakhouse and First National Bank in Pinckneyville for the purpose of subordinating the mortgage lien of City to the mortgage lien of First National Bank in Pinckneyville. City Attorney Don Bigham stated the City entered into a redevelopment agreement stating they would subordinate behind the bank lien. Now the Grecian Steakhouse is refinancing for a better rate and the City needs to subordinate again to be behind the bank’s first mortgage. Commissioner Peradotta made a motion to approve Resolution No. R-2022-21. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT TO EXECUTIVE SESSION

Motion by Commissioner Peradotta, seconded by Commissioner Stotlar to move the meeting to Executive Session at 6:29 p.m. for the discussion of: Section 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee, Section 2 (c) (5) Purchase or lease of real property for the use of the public body, and Section 2 (c) (6) Setting of a price for the sale or lease of property owned by the public body. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RETURN TO REGULAR MEETING

Motion by Commissioner Peradotta, seconded by Commissioner Hicks to return to the regular meeting at 7:12 p.m. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

HIRE WILLIAM KELLERMAN AS AN OPERATOR – UTILITY MAINTENANCE/WATER & SEWER TREATMENT PLANT RELIEF OPERATOR

Commissioner Cicardi requested approval to hire William Kellerman as an Operator – Utility Maintenance/Water & Sewer Treatment Plan Relief Operator. Motion by Commissioner Cicardi, seconded by Commissioner Peradotta to approve the request. On roll call: Commissioners Cicardi, Hicks, Peradotta, and Stotlar voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-10 AUTHORIZING THE SALE OF SURPLUS PROPERTY TO THE VILLAGE OF CASEYVILLE, ILLINOIS BY THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Commissioner Cicardi presented Ordinance No. O-2022-10, an ordinance authorizing the sale of surplus property to the Village of Caseyville, Illinois by the City of Pinckneyville, Perry County, Illinois. Commissioner Cicardi stated this is a Ditch Witch boring machine. Commissioner Cicardi made a motion to approve Ordinance No. O-2022-10. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT

Motion by Commissioner Hicks, seconded by Commissioner Stotlar to adjourn the meeting at 7:14 p.m. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
