Minutes of the Regular Meeting of the City Council of the City of Columbia, Illinois Held in the Council Room of City Hall.

A. Call Meeting to Order

Mayor Hill called the City Council of Columbia, Illinois to order at 7:00 PM.

B. Roll Call

Present: Aldermen Niemietz, Huch, Holtkamp, Martens, Riddle, Garmer, and Khoury.

Absent: Alderman Roessler

Quorum present.

Administrative Staff present:

E. Public Input

Kay Clements and Shirley Garnto with the Violence Prevention Center and Monroe County Outreach Group addressed the Council. Ms. Clements explained the group would like to involve the community in domestic abuse awareness by displaying the color purple throughout the City.

H. Comments & Announcements - Department Directors

Director of Community Development introduced Community Relations Coordinator Marla Rose to the Council.

City Administrator Doug Brimm updated the Council on the planned approach to the 2022 leaf collection program .

City Engineer Chris Smith updated the Council on ongoing projects including the Quarry Road roundabout project, Carl Street Bridge, IDOT resurfacing Route 3, GM&O Trail, and Centerville Road .

A. Consent Agenda

City Administrator Doug Brimm read the Consent Agenda .

1. Motion to Approve Minutes of the August 1, 2022 Regular City Council Meeting

2. Motion to Approve Closed Session Minutes of the August 1, 2022 Regular City Council Meeting

3. Motion to Approve Payment of Vouchers for the Period of July 29, 2022 through August 11, 2022, totaling $493,944.86

4. Motion to Approve Statement of Funds for July 31, 2022

Mayor Hill inquired if the Council wished to remove any items prior to a motion. There we re none.

Motion:

It was moved by Alderman Martens, and seconded by Alderman Khoury, to approve the Consent Agenda as read .

B. Unfinished Business

1. Ordinance No. 3619 Amending Title 5 and Title 18 of The City of Columbia Municipal Code Relating to the Regulation of Video Gaming Establishments

Mr. Brimm stated City staff researched Illinois municipalities located within the 5-county St. Louis Metropolitan Statistical Area . Mr. Brimm explained in an effort to compare Columbia only to municipalities of similar population, the scope of the analysis was reduced to include only the 7 villages/cities. Mr. Brimm stated the average number of video gaming establishments per 1,000 population of the revised study area is 1.34. If the equalized value is applied to Columbia's population, this provides a total of 14.69 licensed establishments. Mr. Brimm and Mayor Hill felt rounding the total to the nearest whole number (15) was appropriate.

It was moved by Alderman Holtkamp, and seconded by Alderman Martens, to pass and approve Ordinance No. 3619, an Ordinance Amending Title 5 and Title 18 of The City of Columbia Municipal Code Relating to the Regulation of Video Gaming Establishments

2. Resolution No. 2022-18 Approving a Collective Bargaining Agreement Between the City of Columbia and the Illinois Fraternal Order of Police Labor Council (Patrol Officers)

Motion:

It was moved by Alderman Martens, and seconded by Alderman Niemietz, to pass and approve Resolution No. 2022-18, a Resolution Approving a Collective Bargaining Agreement Between the City of Columbia and the Illinois Fraternal Order of Police Labor Council (Patrol Officers)

C. New Business

1. Resolution No. 2022-19 Support for TAP Grant for Creekside Park Trail Connector Project

Motion:

It was moved by Alderman Holtkamp, and seconded by Alderman Martens, to pass and approve Resolution No. 2022-19, a Resolution of Support for TAP Grant for Creekside Park Trail Connector Project

2. Consideration of a Motion to Exercise the City Council's Power of Administrative Review of the Zoning Hearing Officer's Ruling on a Rear Yard Setback Variance Request

Director of Community Development Scott Dunakey stated Ms. Soma of 488 Wernings Drive applied for a variance to approve a 6-foot encroachment into the required 30-foot rear yard setback to allow for construction of a covered patio. Mr. Dunakey explained the City's Zoning Hearing Officer approved the request, however, the ruling limits the variance to restrict the patio from ever being enclosed.

After a brief discussion, it was the consensus of the Council to accept the Zoning Hearing Officer's ruling of approving the requested rear yard setback variance and it will become final August 29, 2022.

3. Discussion of Proposed Code Amendments to Regular RV and Utility Trailer Parking on Residential Properties

Director of Community Development Scott Dunakey explained City staff was recently contacted to report a potential code violation regarding several recreational vehicles and camping trailers parked in a driveway. Upon investigation, Mr. Dunakey determined there were no code violations because the Municipal Code does not regulate the parking of such vehicles on private property.

After a brief discussion, Mayor Hill announced these proposed code amendments will be presented at the September 6, 2022 Council meeting for consideration.

4. Discussion of a Special Use Permit Application to Allow a Fast Food Restaurant with a Drive-Through Window on Property Zoned C-2 General Business District Located at 150 Veterans Parkway

Mayor Hill asked the special use permit applicant to provide the Council an overview of the request. Justin Kleinschmidt with Sheppard, Morgan & Schwaab Engineers addressed the Council stating fast food is allowed in C-2 Zoning, but needs a Special Use Permit for a drive-thru. Mr. Kleinschmidt explained the traffic study for Veterans Parkway showed no impact and stated there has been an amendment to the plans regarding the screening.

After a brief discussion, Mr. Dunakey stated a Special Use Permit ordinance will be presented at the September 6, 2022 Council meeting for consideration .

D. Closed Session

Mayor Hill informed the Council that he would entertain a motion to go into Closed Session to discuss 5 ILCS 120/2(c)(1) Appointment, Employment, Compensation, Performance, Discipline, or Dismissal of Specific Employees of the Public Body, 5 ILCS 120/2(c)(5) Purchase or Lease of Real Property for Use of the Public Body, and 5 ILCS 120/2(c)(11) Pending or Probable Litigation

Motion:

It was moved by Alderman Garmer, and seconded by Alderman Niemietz, to direct the Mayor to go into Closed Session at 8:22 PM to 5 ILCS 120/2(c)(1) Appointment, Employment, Compensation, Performance, Discipline, or Dismissal of Specific Employees of the Public Body, 5 ILCS 120/2(c)(5) Purchase or Lease of Real Property for Use of the Public Body, and 5 ILCS 120/2(c)(11) Pending or Probable Litigation

Motion Passed.

Mayor Hill called the Regular Session of the City Council back to order at 8:54 PM . Upon return to Regular Session, Aldermen Niemietz, Huch, Holtkamp, Martens, Riddle, Garmer, Khoury, and Mayor Hill were present.

F. Adjournment

Motion:

It was moved by Alderman Niemietz, and seconded by Alderman Riddle, to adjourn the Regular City Council meeting held Monday, August 15, 2022 at 8:55 PM.
