City of Pinckneyville City Council met Sept. 12.

Here are the minutes provided by the council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer requested to move Commissioner Stotlar’s item on the agenda until after the Mayor’s report and resolutions. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, and Fire Chief Jim Gielow. The Pledge of Allegiance was led by Commissioner Peradotta.

PREVIOUS MINUTES

Commissioner Peradotta made a motion to approve the minutes of the August 22, 2022, regular council meeting. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $1,391,436.85 for the payroll period ending August 2022, up from last year. He stated that the regular hours of 56,779.85 and overtime hours of 1,775 were both up from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi reported the City Park experienced vandalism in the bathroom near the main entrance over the weekend. He asked the public to notify the police of any suspicious activity at the park.

Mayor Spencer gave the following construction updates:

· The sidewalk along State Route 13/154 was delayed due to soil contamination, but should be finished by the end of the September.

· The Illinois Department of Transportation State Route 127 Realignment Project will begin with asbestos removal from the condemned buildings on Monday, September 19, 2022, followed by demolition of the buildings to begin on Wednesday, September 21, 2022. Highway construction will start in March 2023.

· The Pinckneyville/Du Quoin Airport’s apron improvements, for which the city received a $785,000.00 Grant, is almost complete. The next project at the airport for hangar improvements is expected to begin soon.

TREE REMOVAL BY BECKERS LANDSCAPING AND TREE SERVICES

Commissioner Cicardi requested approval of a quote from Beckers Landscaping and Tree Services for tree removal and clean up at old soccer field and park at a total cost of $5,200.00. He stated he received two quotes and Beckers was the lowest bid.

Commissioner Cicardi made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PURCHASE TWO TOSHIBA AS3 VFD PUMPS FROM ILLINOIS ELECTRIC WORKS

Commissioner Cicardi requested approval of a quote from Illinois Electric Works for the purchase of two Toshiba AS3 VFD pumps plus installation at a total cost of $3,168.00. Commissioner Cicardi stated the City would be reimbursed from a pending contract with Ameren. Commissioner Cicardi made a motion to approve the request, which was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PINCKNEYVILLE COMMUNITY HIGH SCHOOL HOMECOMING PARADE

Commissioner Hicks requested approval to allow the Pinckneyville Community High School to hold a homecoming parade, Friday, October 7, 2022, at 10:30 a.m. and stated they will follow the normal route through town. Motion made by Commissioner Hicks, seconded by Commissioner Cicardi to approve the request. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST FROM PCHS BOYS SOCCER TO COLLECT ON CITY STREETS OCTOBER 15, 2022

Commissioner Hicks received a request from the PCHS Boys Soccer team to collect at the 4-way stop on October 15, 2022, from 8 a.m. to 12 p.m. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST FROM PINCKNEYVILLE EAGLES LODGE TO REMAIN OPEN UNTIL 2 A.M. FOR MARDI GRAS AND NEW YEAR’S EVE

Commissioner Hicks stated the City Council will approve this request for the Eagles Lodge, Knights of Columbus, Moose Lodge, and Twisted Vine. Commissioner Hicks made the motion to approve the request for all four locations, which was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TWISTED VINE FESTIVAL ON OCTOBER 22, 2022

Commissioner Hicks received a request from Lauren Moore of the Twisted Vine to discuss the Twisted Vine Festival on October 22, 2022. She stated the festival would run from 10:00 a.m. to 4:00 p.m., and requested to close North Walnut Street from Laurel Street to Jackson Street so that patrons could purchase alcohol and walk safely between their building and the festival on the old hospital lot. Mayor Spencer stated she should apply for a Special Event Liquor License for that date. Ms. Moore asked if she received the Special Event Liquor License if they could set up a table for sales on the festival lot. Mayor Spencer stated they could. Ms. Moore then said the street closure could be tabled, as it would not be needed if they receive the special license and could sell on the festival lot. Commissioner Hicks made a motion to approve the request. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-37 TO APPROVE AND AUTHORIZE REPAIR WORK AT THE CITY LAKE DAM AND SPILLWAY BY HAGENE EXCAVATING LLC

Mayor Spencer presented Resolution No. R-2022-37, a resolution placed on file at the August 22, 2022, regular council meeting, to approve and authorize repair work at the City Lake dam and spillway by Hagene Excavating LLC. Commissioner Hicks made a motion to approve Resolution No. R-2022-37. Commissioner Stotlar seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-39 TO ACCEPT A BID PROPOSAL FROM HAGENE EXCAVATING, LLC, FOR DEMOLITION SERVICES

Mayor Spencer introduced Resolution No. R-2022-39, a resolution to be placed on file to accept a bid proposal from Hagene Excavating, LLC, for demolition services. He stated this is for demolition of the old houses and buildings at the new sewer plant. Commissioner Peradotta made a motion to place on file Resolution No. R-2022-39. Commissioner Stotlar seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-40 TO ENTER INTO AN AGREEMENT FOR SUPERVISORY SERVICES WITH KELSEY PERADOTTA

Mayor Spencer introduced Resolution No. R-2022-40, a resolution to be placed on file to enter into an agreement for supervisory services with Kelsey Peradotta. He stated she was interviewed by Rhonda Shubert, who recommended she be hired to fill in for Rhonda as supervisor over the After-School Program, during Rhonda’s absence over the next few months. Commissioner Stotlar made a motion to place on file Resolution No. R-2022-40. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Stotlar, and Mayor Spencer voted YEA. NAYS: None. ABSTAINED: Commissioner Peradotta. Motion declared carried.

RESOLUTION NO. R-2022-41 TO ENTER INTO AN AGREEMENT FOR CUSTODIAL SERVICES WITH NOAH S. HEPP

Mayor Spencer introduced Resolution No. R-2022-41, a resolution to be placed on file to enter into an agreement for custodial services at the Community Center with Noah S. Hepp. Commissioner Hicks made a motion to place on file Resolution No. R 2022-41. Commissioner Stotlar seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

AARON HAWK REQUESTED TO DISCUSS A BILL RECEIVED FROM THE CITY OF PINCKNEYVILLE

Commissioner Stotlar received a request from Aaron Hawk to discuss a bill received from the City of Pinckneyville and to discuss whose line it is regarding. Mr. Hawk stated that on July 15, 2022, his sewer line backed up, so he contacted David Jennings to investigate the clog, who found that Mr. Hawk’s line was clean. He needed to do an emergency locate in the clay tile that runs in the center of Randolph Street to investigate further, which eventually was found to be clogged with tree roots from the neighbor’s yard. Ordinance No. O-2016-17, Section 3, states “If the connection requires trenching or excavation work across any street, alley or roadway rather than boring, the connection charge shall be $1,750.00.” Mr. Hawk argued he didn’t feel it was his responsibility to pay the $1,750.00 because the clog was under the street, and not on his property. He stated he also had to pay $1,952 to the plumber for the work he did, including filling up the hole with rock. He stated he had discussed the issue with Commissioner Peradotta and Mayor Spencer who offered an alternative to move his line and waive the fee, but this would cost him more plumbing charges. Mr. Hawk believes it is the City’s responsibility since the clog was in the center of the street. City Attorney Don Bigham stated that a line in the middle of a street should be the City’s line, and if it is not listed in the City’s records as a public line, then it needed to be investigated. Commissioner Cicardi stated if it is in the middle of the street, it is the City’s responsibility. City Attorney Don Bigham stated the City’s engineers should get involved so it can be fixed. Further discussion went on about the amount of the fee. Commissioner Peradotta stated the fee is for the workers and their equipment to fill the hole with concrete and make the street smooth. Commissioner Stotlar stated the fee is ridiculous and he apologized for voting yes on the ordinance, which he stated should be adjusted. Mayor Spencer stated he would investigate the matter further, and if any adjustment is to be made to the fee, it will be done afterwards. He stated he ran into a similar situation himself, and he had to pay the fee.
