The City Council of Red Bud, Randolph County, Illinois met on Monday, February 6, 2023, at 6:00 P.M. at Red Bud City Hall, City Council Chambers.

Acting Mayor Harbaugh welcomed City Clerk Joanne Cowell back from her extensive recovery and thanked Pam Poetker for her efforts in covering the city clerk position. Clerk Cowell also expressed her gratitude to Poetker for all she did.

V. Approval of Estimated and Listed Bills

1. Training Request for Southern Il Criminal Justice Summit-J. Brittingham

Motion made by Council Member Hanebutt, seconded by Council Member Schwartzkopf, to approve authorization for John Brittingham to attend training entitled “Southern Illinois Criminal Justice Summit” on March 3-4, 2023, in Effingham, IL, with a registration fee of $85; lodging, meals and transportation are required. Motion made by Council Member Guebert, seconded by Council Member Donjon, to authorize approval of ORDINANCE NO. 1513: AN ORDINANCE AMENDING TITLE XV, CHAPTER 150 OF THE CITY OF RED BUD CODE OF ORDINANCES 2021 PERTAINING TO NON-ROAD INTERSECTION CROSSWALKS. 1. Request from YMCA to Reserve Ratz Park Soccer Field - March 20th - May 20th

Motion made by Council Member Schwartzkopf, seconded by Council Member Piel, to authorize approval of a request from the YMCA, to reserve Ratz Park soccer field from March 20 – May 20, 2023, excluding Easter weekend. I. Economic Development Commission – No Meeting

1. Appointment of Jennifer Gregson to Commission (RBRH)

Motion made by Council Member Donjon, seconded by Council Member Schwartzkopf, to authorize approval of the appointment of Jennifer Gregson, CAO of Red Bud Regional Hospital, to the Economic Development Commission. The vote was as follows: Guebert, aye; Hanebutt, aye; DeMond, aye; Nevois, aye; Donjon, aye; Piel, aye; Schwartzkopf, aye. Motion carried.

2. Edits to Enterprise Zone Territory

Council Member Piel explained the edits to the map. Adm. Assist.

Poetker said that there will be no cost to the city, as Randolph County is working with an interested company, who will pay the change and application fees. The application form is posted on the city website and is available for projects over $10,000.

Motion made by Council Member Piel, seconded by Council Member Nevois, to authorize approval of the amended enterprise zone territory map, as presented and at no cost to the city. The vote was as follows: Hanebutt, aye; DeMond, aye; Nevois, aye; Donjon, aye; Piel, aye; Schwartzkopf, aye; Guebert, aye. Motion carried.

XI. New Business

A. 2022 Mayor’s Annual Report

Acting Mayor Harbaugh learned from IML that the mayor is required to annually report on the affairs of the city. She highlighted the report, which was included in the packet, and thanked everyone for their cooperation during the past year in accomplishing many things.

B. Review of February Calendar

No changes

C. Other Comments

Lois Mesnarich addressed the council regarding the South Main Street water main break, which threw forceful debris and water at her home on June 12, 2021. She asked that the city do the Christian, humane, decent, and right thing and pay restitution for the damages to her home.

Acting Mayor Harbaugh replied that she had been told before that the city’s insurance denied the claim and that she should turn this into her own homeowner’s insurance.

Attorney Ray stated that Mrs. Mesnarich had been told before that the city has tort immunity and cannot set a precedent of paying for this.

Donna Barber, Mrs. Mesnarich’s daughter, also addressed the council stating that even people whom she does not know comment that the city should be responsible for the damage to her mother’s home.

Motion made at 6:38 P.M. by Council Member Hanebutt, seconded by Council Member Nevois, to adjourn the meeting. The vote was as follows: all ayes. Motion carried.
