City of Pinckneyville City Council met May 8.

ROLL CALL
Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, Police Chief Kenny Kelley, Fire Chief Jim Gielow, Economic Development Coordinator Carrie Gilliam, and Utility Superintendent Brad Boulton. The Pledge of Allegiance was led by Commissioner Peradotta.
PREVIOUS MINUTES
Commissioner Hicks made a motion to approve the minutes of both the April 24, 2023, public hearing and regular council meeting. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
TREASURER’S REPORT
Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $651,032.63 for the payroll period ending April 2023, up from last year. He stated that the regular hours of 23,545.50 were up from last year, while overtime hours of 780 were down from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ACCOUNTS PAYABLE
Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RECOGNITION
Mayor Spencer presented Commissioner Cicardi with a plaque recognizing his public service as Commissioner of Public Property. He thanked him for four years of service and his donation of time.

RESOLUTION NO. R-2023-20 AUTHORIZING AND APPROVING AN AMENDMENT TO NATURAL GAS ALL-RIGHTS SALES AGREEMENT WITH THE INTERSTATE MUNICIPAL GAS AGENCY
Commissioner Kuhnert presented Resolution No. R-2023-20, a resolution placed on file at the April 24, 2023, regular council meeting, authorizing and approving an Amendment to Natural Gas All-Rights Sales Agreement with the Interstate Municipal Gas Agency. Commissioner Kuhnert made a motion to approve Resolution No. R-2023-20. Commissioner Hicks seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2023-21 TO ACCEPT A RELEASE OF CLAIMS AGAINST THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS – AARON HAWK
Commissioner Stotlar presented Resolution No. R-2023-21, a resolution to accept a release of claims against the City of Pinckneyville, Perry County, Illinois, from Aaron Hawk. ORDINANCE NO. O-2023-04 TO ENTER INTO A SALES AGREEMENT FOR PURCHASE OF REAL ESTATE LOCATED AT 202 SOUTH WALNUT STREET AND 204 SOUTH WALNUT STREET, PINCKNEYVILLE, ILLINOIS
Mayor Spencer presented Ordinance No. O-2023-04, an ordinance placed on file at the April 24, 2023, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a sales agreement for purchase of real estate located at 202 South Walnut Street and 204 South Walnut Street, Pinckneyville, Illinois. Commissioner Peradotta made a motion to approve Ordinance No. O-2023-04. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ORDINANCE NO. O-2023-07 AMENDING AN ORDINANCE ENTITLED “ZONING ORDINANCE OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS” BEING ORDINANCE NO. O-2014-06, AS HERETOFORE AMENDED TO DATE
Mayor Spencer introduced Resolution No. O-2023-07, an ordinance to be placed on file, amending an ordinance entitled “Zoning Ordinance of the City of Pinckneyville, Perry County, Illinois” being Ordinance No. O-2014-06, as heretofore amended to date. Mayor Spencer stated this Ordinance was presented at a Public Hearing on April 24, 2023. Mike Kovic, Chairman of the Zoning Board, stated they continue to be challenged with new situations and technology so they have made adjustments in the ordinance to clarify these situations. Commissioner Peradotta made a motion to place on file Ordinance No. O-2023- 07. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
EMERGENCY APPROVAL OF QUOTE FROM CDS OFFICE TECHNOLOGIES TO UPGRADE NETWORK AT BOTH WATER PLANT AND UTILITY OFFICE
Mayor Spencer requested approval of an emergency quote for $2,544.97 from CDS Office Technologies to upgrade network switches, routers, and firewalls at both water plant and utility office to be paid for by water. Utility Superintendent Brad Boulton stated network, switches and firewall at the water plant are from 2016, and the update to the SCADA system requires these all be updated to provide better security to the network. Motion made by Commissioner Hicks, seconded by Commissioner Kuhnert to approve the request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. SOUTHERN ILLINOIS AGGREGATION PARTNERSHIP MUNICIPALITY POWER OF ATTORNEY
Mayor Spencer stated this is done every four years. He introduced Jordan Haarmann of AGE to provide information to the council. He stated the Southern Illinois Aggregation Partnership represents nearly 100 communities to negotiate electric supply rates in bulk for their residents. They currently save residents who are currently participating about 65% in their energy bills. The contract ends in December 2023, so they are in the process of seeking renewal rates from suppliers. The limited power of attorney gives AGE the authority to initiate contracts with the lowest electric supplier. All municipalities in this program will need to sign this power of attorney. He stated that while electric rates have increased, they still expect to save 15-25% over the new Ameren rates, which will be released at the end of this month. He stated voters approved participation in this program back in 2013. Motion made by Commissioner Peradotta, seconded by Commissioner Stotlar to approve execution of the power of attorney. PUBLIC COMMENT
Jeff Egbert of the Pinckneyville Press – Du Quoin Weekly asked if the pool is set to open on May 20, 2023. Commissioner Kuhnert corrected him that it is May 22, 2023. Mr. Egbert noticed there’s been no work out at the pool and the pool is dry. Commissioner Kuhnert replied he would be getting on it pretty quickly. Mayor Spencer asked Utility Superintendent Brad Boulton to give an update on the pool. He stated the pool has been drained and cleaned and they found two small cracks where ground water was coming in, so they have contacted a company to make some small repairs before they fill the pool.
Mayor Spencer called on Josh Giacomo of the American Thresherman’s Association regarding the grass at the park. He said the grass is pretty high and asked if they could cut it for hay. Commissioner Hicks asked if this was west of the ballfields and Mayor Spencer answered Yes. The Council agreed they can cut the field on a scheduled basis.
Mayor Spencer provided notice that a special meeting will be held Thursday morning, May 11, 2023, at 9:00 a.m. He stated a notice will be posted tomorrow morning.
