ROLL CALL
Mayor Spencer called the special meeting of the Pinckneyville City Council to order at 9:00 a.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, and Mayor Robert L. Spencer. Mayor Spencer requested permission for Commissioner William B. Stotlar to attend the meeting by phone. Commissioner Peradotta made the motion, seconded by Commissioner Kuhnert to allow Commissioner Stotlar to attend by phone. On roll call: Commissioners Hicks, Kuhnert, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried and Commissioner Stotlar joined the special meeting. Mayor Spencer declared a quorum present. Administrative staff present: City Clerk Melissa Kellerman and City Attorney Don Bigham.
RESOLUTION NO. R-2023-22 TO ENTER INTO A SWIMMING POOL MANAGEMENT SERVICE AGREEMENT WITH JO C. SUMMERS FOR THE MANAGEMENT OF THE CITY POOL
Commissioner Kuhnert presented Resolution No. R-2023-22, a resolution placed on file at the May 22, 2023, regular council meeting authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Swimming Pool Management Service Agreement with Jo C. Summers for the management of the City Pool. Commissioner Kuhnert made a motion to approve Resolution No. R-2023-22. Commissioner Hicks seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
APPROVAL OF INCREASE IN COMPENSATION OF POOL MANAGER BY $676.00 TO COVER INCREASE IN COST OF LIABILITY INSURANCE
Due to the increased cost of liability insurance coverage for the pool manager, Commissioner Kuhnert requested approval to increase the compensation of the pool manager by $676.00 payable in the first installment. Commissioner Kuhnert made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. RESOLUTION NO. R-2023-25 TO ENTER INTO AN EMPLOYMENT CONTRACT FOR THE ASSISTANT UTILITY SUPERINTENDENT AND PARK MANAGER (DANNY L. NAUGLE)
Commissioner Kuhnert introduced Resolution No. R-2023-25, a resolution to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an employment contract for the Assistant Utility Superintendent and Park Manager with Danny L. Naugle. City Attorney Don Bigham stated the five-year contract term will start June 13, 2023, after the council gives final approval. He stated he has talked to the Laborer’s Union representative and notified them the City intends to replace the employee in the utility department. He stated the contract allows for variable hours to allow for adjustment when needed in evenings and on weekends. Any hours over 80 in a two-week period require approval by the Mayor or Commissioner of Public Property. There was discussion regarding the concern that his priority would be park management in the event there was a gas emergency or need for him to fulfill the obligation to back up the Utility Superintendent in his absence. City Attorney Don Bigham stated the wording of the contract specifies that the Mayor or Commissioner of Public Property can approve and delegate that authority, so the draft is correct as it is stated. Commissioner Kuhnert made a motion to place on file Resolution No. R-2023-25. Commissioner Hicks seconded the motion. RESOLUTION NO. R-2023-23 TO AUTHORIZE AND APPROVE CHANGE ORDER NO. 2 (WHICH INCLUDES CHANGE ORDER REQUESTS # 1, #4, AND #5) WITH HAIER PLUMBING & HEATING, INC. FOR THE ILLINOIS STATE ROUTE 13/154 SIDEWALK & DRAINAGE IMPROVEMENTS PROJECT
Mayor Spencer presented Resolution No. R-2023-23, a resolution of the City of Pinckneyville, Perry County, Illinois, placed on file at the May 22, 2023, regular council meeting to authorize and approve Change Order No. 2 (which includes Change Order Requests #1, #4, and #5) with Haier Plumbing & Heating, Inc. for the Illinois State Route 13/154 Sidewalk & Drainage Improvements Project. Commissioner Hicks made a motion to approve Resolution No. R-2023-23. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2023-26 TO AUTHORIZE AND APPROVE AN ADDENDUM TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS AND THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, THE SOUTHERN AND CENTRAL ILLINOIS LABORERS’ DISTRICT COUNCIL, AND LABORERS’ LOCAL 773
Mayor Spencer introduced Resolution No. R-2023-26, a resolution to be placed on file to authorize and approve an Addendum to the Collective Bargaining Agreement between the City of Pinckneyville, Perry County, Illinois and the Laborers’ International Union of North America, the Southern and Central Illinois Laborers’ District Council, and Laborers’ Local 773. City Attorney Don Bigham stated this is to address questions about assigning overtime in the water plan because they don’t follow a normal shift schedule. It offers better clarification that the on-shift operator can include any employee filling the shift as a relief operator. Commissioner Peradotta made a motion to place on file Resolution No. R-2023-26. Commissioner Kuhnert seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2023-27 TO ACCEPT THE BID OF KAMADULSKI EXCAVATING AND GRADING COMPANY, INC. FOR LABOR, MATERIALS, AND EQUIPMENT FOR THE ILLINOS STATE ROUTE 127 SEWER LINE RELOCATION PROJECT
Mayor Spencer introduced Resolution No. R-2023-27, a resolution of the City of Pinckneyville, Perry County, Illinois, to accept the bid of Kamadulski Excavating and Grading Company, Inc. for labor, materials, and equipment for the Illinois State Route 127 Sewer Line Relocation Project. The bid for this project was $1,881,657.00 and was the lowest of the two bids received. It will cover the sewer line from the Courthouse to Kellerman’s Feed Store and includes a portion of North Main Street. City Attorney Don Bigham stated IDOT expects to start on the highway construction from the Courthouse to Kellerman’s by mid August, so this project needs to get started soon. He also stated the City is contractually-bound and obligated with IDOT to do this project which moves the sewer line into the new bicycle lane. He also stated the current sewer system is 80-90 years old, so it is due to be replaced or upgraded, and it is best to relocated it while this project is underway. Commissioner Peradotta made a motion to place on file Resolution No. R-2023-27. Commissioner Kuhnert seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
