City of Pinckneyville City Council met June 12.

Here is the agenda provided by the council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, and Fire Chief Jim Gielow. The Pledge of Allegiance was led by Commissioner Hicks.

PREVIOUS MINUTES

Commissioner Hicks made a motion, which was seconded by Commissioner Peradotta, to approve the minutes of both the May 22, 2023, regular council meeting and the May 31, 2023, Special Meeting. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $839,047.56 for the payroll period ending May 2023, up from last year. He stated that the regular hours of 30,682.50 and overtime hours of 952.50 were both down from last year. He stated the increase in payroll is mostly due to pay rate increases in the union contracts. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Hicks invited everyone to support the Perry County Fair which stated last Friday and continues through June 17th. Jeff Egbert of the Pinckneyville Press reminded everyone that this year’s fair includes a wrestling event Saturday night, June 17th.

STREET CLOSURES FOR ST. BRUNO CATHOLIC CHURCH ANNUAL PICNIC

St. Bruno Catholic Church requested permission to close the streets surrounding the church grounds from 10:00 a.m. July 15, 2023, through 8:00 a.m. July 16, 2023, for their annual parish picnic. A map of the requested street closures was attached to the request. Commissioner Peradotta stated the Street Department would put out cones and barricades on Friday at each corner for them to use and would pick them back up on Monday. Commissioner Hicks made a motion to approve the request which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-25 TO ENTER INTO AN EMPLOYMENT CONTRACT FOR THE ASSISTANT UTILITY SUPERINTENDENT AND PARK MANAGER (DANNY L. NAUGLE)

Commissioner Kuhnert presented Resolution No. R-2023-25, a resolution placed on file at the May 31, 2023, special meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an employment contract for the Assistant Utility Superintendent and Park Manager with Danny L. Naugle. Commissioner Kuhnert made a motion to approve Resolution No. R-2023-25. Commissioner Hicks seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-08 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO A LEASE ON THE PREMISES AT 5512 STATE ROUTE 154, PINCKNEYVILLE, ILLINOIS, WITH PERRY-JACKSON COUNTY CHILD ADVOCACY CENTER

Commissioner Kuhnert introduced Ordinance No. O-2023-08, an ordinance to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a lease on the premises at 5512 State Route 154, Pinckneyville, Illinois, with Perry-Jackson County Child Advocacy Center. This is a 3-year lease renewal. Betti Mucha, Executive Director of the Perry Jackson Child Advocacy Center, was present and offered a booklet and brochure to each council member. She stated they opened in 2002 and while their office is in Perry County, they travel to Jackson County to serve that community as well. Commissioner Kuhnert made a motion to place on file Ordinance No. O-2023-08. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PURCHASE A PROGRAM LOGIC CONTROLLER FROM THE LOGICON GROUP

Commissioner Kuhnert requested approval to purchase a Program Logic Controller from Logicon Group at a cost not to exceed $9,425.00. Motion made by Commissioner Kuhnert, seconded by Commissioner Peradotta to approve the request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

HIRE WYATT VAUGHN AS PART-TIME SUMMER WORKER

Commissioner Kuhnert requested approval to hire Wyatt Vaughn as a part-time summer worker for mowing. Motion made by Commissioner Kuhnert, seconded by Commissioner Hicks to approve the request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-10 TO AMEND SECTION 52.034 OF THE CODE OF ORDINANCES OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Commissioner Peradotta introduced Ordinance No. O-2023-10, an ordinance to be placed on file, to amend Section 52.034 of the Code of Ordinances of the City of Pinckneyville, Perry County, Illinois. City Attorney Don Bigham stated this amendment clarifies the current code stating the connection fee is for both initial connections and also if trenching is required for repairs to streets when connecting to a private water/sewer line. He also stated it sets a scale for each 200 square feet. Commissioner Stotlar asked what the fee would be if the customer added rock. City Attorney Don Bigham stated the fee is $1,750 if they have to excavate a city road or alley. Commissioner Peradotta stated that adding rock does not repair the street. The City repairs the street with concrete. The fee provides the funds to do the repair. Commissioner Stotlar stated the fee was too high and that he would not be voting in favor of the Ordinance. Motion made by Commissioner Peradotta to place on file Ordinance No. O-2023-10. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, and Mayor Spencer voted YEA. NAYS: Commissioner Stotlar. Motion declared carried.

CONSTRUCTION ON IOWA STREET TO BEGIN MONDAY, JUNE 12, 2023 CONTRACTED BY RED DOT CONSTRUCTION

Commissioner Peradotta reminded the public that construction on Iowa Street began this morning with tile being installed. The construction work is contracted by Red Dot Construction.

GRASS CLIPPINGS, LEAVES, AND LIMB PLACEMENT FOR PICK UP

Commissioner Peradotta read the following statement: “Reminder to residents not to blow grass clippings or leaves into the street as it can be hazardous and can clog the storm sewer drainage system. Loose grass clippings and leaves should be placed separately from limbs in the edge of the resident’s yard within 5 feet of the street or sidewalk for pick up by street workers. Placing them in the street is a violation of the City Ordinance which comes with a warning and/or fine.”

RESOLUTION NO. R-2023-26 TO AUTHORIZE AND APPROVE AN ADDENDUM TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS AND THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, THE SOUTHERN AND CENTRAL ILLINOIS LABORERS’ DISTRICT COUNCIL, AND LABORERS’ LOCAL 773

Mayor Spencer presented Resolution No. R-2023-26, a resolution placed on file at the May 31, 2023, special meeting, to authorize and approve an Addendum to the Collective Bargaining Agreement between the City of Pinckneyville, Perry County, Illinois and the Laborers’ International Union of North America, the Southern and Central Illinois Laborers’ District Council, and Laborers’ Local 773. Commissioner Peradotta made a motion to approve Resolution No. R-2023-26. Commissioner Kuhnert seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-27 TO ACCEPT THE BID OF KAMADULSKI EXCAVATING AND GRADING COMPANY, INC. FOR LABOR, MATERIALS, AND EQUIPMENT FOR THE ILLINOS STATE ROUTE 127 SEWER LINE RELOCATION PROJECT

Mayor Spencer presented Resolution No. R-2023-27, a resolution of the City of Pinckneyville, Perry County, Illinois, placed on file at the May 31, 2023, special meeting, to accept the bid of Kamadulski Excavating and Grading Company, Inc. for labor, materials, and equipment for the Illinois State Route 127 Sewer Line Relocation Project. Commissioner Hicks made a motion to approve Resolution No. R-2023-27. Commissioner Stotlar seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-09 AUTHORIZING APPROVAL OF AN APPLICATION FROM STEVE TANNER AND DAWN TANNER FOR FAÇADE IMPROVEMENT GRANT FUNDS

Mayor Spencer noted the Tanners were not present at the meeting, so this item will be held over until the next City Council Meeting on June 26, 2023.

BETH MILLER-PORTER REQUESTS TO DISCUSS SEWER CHARGES FOR PANTHER WASH

Beth Miller-Porter and Amy Chapman, representing Panther Wash, requested alternatives to their current sewer charges on their city utility bill. One alternative would be to lower their sewer charges to a fairer amount in line with other businesses of their type. Another alternative would be to have a second water meter installed which would service the car wash bays only and not include a sewer charge, while their current meter would service their office in the car wash that included a toilet which goes into the sewer. Mayor Spencer stated the business would need to pay for the second meter which would be around $300.00 not counting installation charges which would be billed to the customer after installation. Commissioner Hicks asked what the second meter would do. Ms. Chapman stated one meter would be fore water and sewer in their office, and the other would be for water only for the car wash bays. She indicated it would work the same as Beelman’s. Commissioner Hicks stated he would vote No, and that everyone should have to pay for sewer. Ms. Porter stated she asked previously to have sewer charges waived until the issue was resolved, but that has not been done. She stated they are paying $5,000.00 to $6,000.00 to have the solids (sludge) hauled off that compact in the car wash pits, yet they are also being charged a sewer charge. She stated this is unfair because the other car wash in town does not pay a sewer fee because his business was established prior to the Ordinance in 1997 that required everyone to hook into the sewer. Commissioner Stotlar asked how many gallons of water the car wash used, and Ms. Chapman presented him with a copy of a recent bill. Commissioner Stotlar stated he thought the other car wash should be required to pay sewer charges or Panther Wash should have them removed. Ms. Porter then offered another alternative which would be to only have to pay half the sewer rate charge. Mayor Spencer explained that when the new ordinance went into effect, Brand’s car wash was grandfathered in, and that would have been the time for him to hook on to the sewer system if he wished to do so. Anyone purchasing the property at a later date would be required to hook on. Commissioner Kuhnert asked if there was a way to test the water coming from the car wash to see if it would pass EPA requirements. If so, he would consider the second meter. Ms. Porter stated that after it goes through the pit, it’s much cleaner water. She also stated that at an earlier meeting, Brad Boulton thought it would pass. She stated she has been trying to get this resolved since Roger Seibert was City Attorney. Ms. Chapman stated that some area communities they checked with offer a reduced rate for businesses who use larger quantities of water over a set amount. Commissioner Stotlar stated maybe there could be a reduced rate for those using over 100,000 gallons. He stated he would have to do research to see who the largest commercial water users are first. The Mayor stated the Prison would be the largest, but they have their own contract. Mayor Spencer then asked what the council wanted to do: 1. Provide a second meter for water only or 2. Give them a reduced rate for sewer. Commissioner Kuhnert made a motion to reduce their sewer rate in half. Commissioner Stotlar made a motion to provide a second meter or reduce the rate on their sewer. City Attorney Don Bigham stated the Code of Ordinances would have to be amended to re-establish fees. Both motions were taken back. Several commercial names were brought up as probably large water users. Commissioner Kuhnert noted that Beelman’s separate meter is only for adding water to the concrete trucks, so that water clearly does not go into the sewer system. Commissioner Stotlar stated if Panther Wash is using 10 times what everyone else is, they deserve a break. Ms. Porter also stated that some newer car washes don’t have pits, they have grinders and it all goes through the sewer system. Commissioner Stotlar stated he would review commercial water usage tomorrow and have a proposal for the next council meeting on June 26, 2023. Ms. Porter asked again for a break while the council is making a determination. Commissioner Kuhnert stated they should see the usage numbers before a decision is made on that. Commissions Stotlar will add this item to his agenda and have a proposal for the council at the next meeting.

PUBLIC COMMENT

Jeff Egbert of the Pinckneyville Press asked if there had been a meeting date set yet with the Perry County Soccer Association. Mayor Spencer said he talked to the engineer and is waiting on an available date before contacting them to set up a meeting. Mr. Egbert said the Pinckneyville Press would like to attend the meeting.
