City of Pinckneyville City Council met July 8.

Here are the minutes provided by the council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, and Fire Chief Jim Gielow. The Pledge of Allegiance was led by Commissioner Kuhnert.

PREVIOUS MINUTES

Commissioner Hicks made a motion to approve the minutes of the June 24, 2024, regular council meeting. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $1,309,327.11 for the payroll period ending June 2024, up from last year. He stated that the regular hours of 47,091 were up from last year, while overtime hours of 1,159.5 were down from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable with two additional invoices: IMGA $8,889.50 and Sparklight $193.58; for a total added of $9,083.08. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-28 AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, AND THE PINCKNYVILLE RURAL FIRE PROTECTION DISTRICT

Commissioner Hicks presented Resolution No. R-2024-28, a resolution placed on file at the June 24, 2024, regular council meeting, authorizing an intergovernmental agreement between the City of Pinckneyville, Perry County, Illinois, and the Pinckneyville Rural Fire District. Commissioner Hicks made a motion to approve Resolution No. R-2024-28, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-29 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO AN EMPLOYMENT CONTRACT FOR A PART TIME FIRE CHIEF – CURTIS MILLER

Commissioner Hicks presented Resolution No. R-2024-29, a resolution placed on file at the June 24, 2024, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an employment contract for a part time fire chief – Curtis Miller. Commissioner Hicks made a motion to approve Resolution No. R-2024-29, which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried. Commissioner Hicks congratulated Mr. Miller on his new position.

SOUTHERN ILLINOIS CHAPTER 32 OF INTERNATIONAL HARVESTER COLLECTORS’ DONATION REQUEST

The Southern Illinois Chapter 32 of International Harvester Collectors requested a $1,500.00 donation from the hotel/motel tax fund to assist with advertising and signage for their 4th annual Cubfest in Pinckneyville, at the Perry County Fairgrounds, on September 20 and 21, 2024. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-26 SUPPORTING THE DEVELOPMENT OF STREETSCAPE ENHANCEMENTS FOR THREE CITY BLOCKS ON SOUTH WALNUT STREET IN THE CITY OF PINCKNEYVILLE, ILLINOIS, AND AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR A GRANT THEREFORE

Commissioner Peradotta presented Resolution No. R-2024-26, a resolution placed on file at the June 24, 2024, regular council meeting, supporting the development of Streetscape enhancement for three city blocks of South Walnut Street in the City of Pinckneyville, Illinois bound to the North by Water Street (Illinois State Route 154) and to the South by West Randolph Street and authorizing submission of an application for a grant therefore. City Attorney Don Bigham stated IDOT has since sent out an updated resolution example, but believes the one being approved will be sufficient. If not, a revised resolution will be approved at a later date. Commissioner Peradotta stated the City could possibly have some or all of the local match forgiven due to the low income of our area. Commissioner Peradotta made a motion to approve Resolution No. R-2024-26, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPROVE FINAL PAY ESTIMATE NO. 2 TO K.R.B. EXCAVATING, INC., FOR MANN DRIVE RECONSTRUCTION PROJECT

Commissioner Peradotta made a motion to approve Final Pay Estimate No. 2 to K.R.B. Excavating, Inc., for $16,059.16 for the Mann Drive Reconstruction Project using MFT/Rebuild Illinois Funds approved in Resolution R-2023-40. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CITY STREETS TO BE OILED AND CHIPPED JULY 10 AND 11, WEATHER PERMITTING

Commissioner Peradotta announced the delay of one day for oiling and chipping of city streets due to the expected rain on July 9. City streets to be oiled and chipped on July 10 and 11, weather permitting, will be the streets between Sronce Automotive to Blue Bunting Road East of the prison to the North and St. Bruno and Columbian Club Hall area to the North edge of City Limits/Waterworks Road.

RESOLUTION NO. R-2024-30 AUTHORIZING DESTRUCTION OF AUDIO RECORDINGS OF CLOSED COUNCIL MEETINGS OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, CONDUCTED ON OR BEFORE DECEMBER 31, 2022

Commissioner Stotlar made a motion to approve Resolution No. R-2024-30, a resolution authorizing the destruction of audio recordings of the closed council meetings of the City of Pinckneyville, Perry County, Illinois, conducted on or before December 31, 2022. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-31 AUTHORIZING NOTICE OF SALE OF MUNICIPALLY OWNED REAL PROPERTY (705 SOUTH DOUGLAS STREET)

Mayor Spencer presented Resolution No. R-2024-31, a resolution authorizing Notice of Sale of Municipally Owned Real Property (705 South Douglas Street). Commissioner Peradotta made a motion to approve Resolution NO. R-2024-31, which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-32 AUTHORIZING NOTICE OF SALE OF MUNICIPALLY OWNED REAL PROPERTY (701 DUCKORTH STREET)

Mayor Spencer presented Resolution No. R-2024-32, a resolution authorizing Notice of Sale of Municipally Owned Real Property (701 Duckworth Street). Commissioner HIcks made a motion to approve Resolution NO. R-2024-32, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2024-06 APPROVING AND AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO AN AGREEMENT GRANTING VISIBILITY EASEMENT TO THE CITY OF PINCKNEYVILLE, ILLINOIS

Mayor Spencer introduced Ordinance No. O-2024-06, an ordinance to be placed on file, approving and authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an agreement granting visibility easement to the City of Pinckneyville, Illinois. He stated this is the property on the corner of Laurel Street and Illinois State Route 127. IDOT has surveyed the area for poor visibility, and the landowner agrees to grant the City a visibility easement to clean out the shrubs and bushes. Commissioner Peradotta made a motion to place on file Ordinance No. O-2024-06, which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PUBLIC COMMENT

Laura Loos thanked the City Council for their commitment to improve the visibility at Laurel Street and Illinois State Route 127. Mayor Spencer stated, “It will take time, but it will be done.”

Jeff Egbert of the Weekly Press questioned if there have been any threats to the City due to the executive session discussion of 2 (c) (8) on the agenda. Mayor Spencer explained it was to discuss a Public Safety issue. City Attorney Don Bigham stated there is no case law on the statute, but that it fits the needs of the intended discussion which is for security procedures of a reasonably potential danger to the safety of public property.

ADJOURNMENT TO EXECUTIVE SESSION

Motion by Commissioner Peradotta, seconded by Commissioner Kuhnert to move the meeting to Executive Session at 6:17 p.m. for the discussion of: Section 2 (c) (2) Collective negotiating matters or deliberations concerning salary schedules, Section 2 (c) (8) Security procedures, school building safety and security, and use of personnel and equipment to respond to an actual, a threatened, or a reasonably potential danger to the safety of employees, students, staff, the public, or public property, and Section 2 (c) (11) Litigation, pending or probable. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RETURN TO REGULAR MEETING

Motion by Commissioner Peradotta, seconded by Commissioner Kuhnert to return to the regular meeting at 6:58 p.m. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT

Motion by Commissioner Hicks, seconded by Commissioner Kuhnert to adjourn the meeting at 7:00 p.m. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
