ROLL CALL
Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman and City Attorney Don Bigham. The Pledge of Allegiance was led by Commissioner Kuhnert.
PREVIOUS MINUTES
Commissioner Peradotta made a motion to approve the minutes of October 28, 2024, Regular Council Meeting. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
TREASURER’S REPORT
Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $2,101,572.29 for the payroll period ending October 2024, up from last year. He stated that the regular hours of 76,519.50 were up from last year, while overtime hours of 1,768.50 were down from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ACCOUNTS PAYABLE
Commissioner Stotlar made a motion to approve the accounts payable, with the addition of seven invoices: $180.58 – Dan Naugle – Gas Pipeline Safety Meeting Expenses; $296.22 – three invoices from Egyptian Electric for the Airport; $84.87 – Frontier for Community Center; $569.91 – Oakley Services for generator maintenance; $3,698.00 – A & W Plumbing to bore a water lien on Mildred Drive; for a total added of $4,829.58. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-41 TO ENTER INTO A CERTIFIED WASTEWATER OPERATOR SERVICES AGREEMENT WITH ALBERS WATER SERVICES, LLC
Commissioner Kuhnert presented Resolution No. R-2024-41, a resolution placed on file at the October 28, 2024, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Certified Wastewater Operator Service Agreement with Albers Water Services, LLC. Commissioner Kuhnert made a motion to approve Resolution No. R-2024-41, which was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ORDINANCE NO. O-2024-13 TO ESTABLISH THE NAME OF SOCCER PARK ROAD
Commissioner Peradotta presented Ordinance No. O-2024-13, an ordinance to establish the name of Soccer Park Road in the City of Pinckneyville, Perry County, Illinois. Commissioner Peradotta stated this was originally named Queens Way Extension and stated the soccer park is now open, so it is being given an official name. Commissioner Peradotta made a motion to approve Ordinance No. O-2024-13, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
FISCAL YEAR 2024 AUDIT
Commissioner Stotlar made a motion to approve the Fiscal Year 2024 audit report that was placed on file at the October 28, 2024, regular council meeting. Commissioner Peradotta seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2024-45 TO ACCEPT A PROPOSAL FROM SHEFFER INSURANCE AGENCY FOR INSURANCE COVERAGE THROUGH THE ILLINOIS COUNTIES RISK MANAGEMENT TRUST
Commissioner Stotlar introduced Resolution No. R-2024-45, a resolution to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to accept a proposal from Sheffer Insurance Agency for insurance coverage through the Illinois Counties Risk Management Trust for property insurance. Commissioner Stotlar stated this renewal package has a lower premium than last year. Commissioner Stotlar made a motion to place on file Resolution No. R-2024-45, which was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2024-46 ESTIMATING THE AMOUNT OF TAX LEVY FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, EXCLUDING THE LIBRARY FUND FOR THE FISCAL YEAR ENDING APRIL 30, 2025
Commissioner Stotlar presented Resolution No. R-2024-46, a resolution estimating the amount of Tax Levy for the City of Pinckneyville, Perry County, Illinois, excluding the Library Fund for the fiscal year ending April 30, 2025. Commissioner Stotlar made a motion to approve Resolution No. R-2024-46, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2024-47 ESTIMATING THE AMOUNT OF TAX LEVY FOR THE PINCKNEYVILLE PUBLIC LIBRARY OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, FOR THE FISCAL YEAR ENDING APRIL 30, 2025
Commissioner Stotlar presented Resolution No. R-2024-47, a resolution estimating the amount of Tax Levy for the Pinckneyville Public Library of the City of Pinckneyville, Perry County, Illinois, for the fiscal year ending April 30, 2025. Commissioner Stotlar made a motion to approve Resolution No. R-2024-47, which was seconded by Commissioner Peradotta. City Attorney Don Bigham explained that in the past the library’s levy was included with the City’s Levy Ordinance, but since the Audit showed a shortage of funds for the library, the library will hold a Truth in Taxation Hearing on December 9, 2024, at 5:30 p.m., to increase their levy for this year. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2024-48 APPROVING AND AUTHORIZING STOP LOSS INSURANCE COVERAGE WITH AMI GROUP, INC. AND NORTHWIND
Commissioner Stotlar introduced Resolution No. R-2024-48, a resolution to be placed on file, approving and authorizing stop loss insurance coverage with AMI Group, Inc. (formerly IPMG) and Northwind. Commissioner Stotlar made a motion to place on file Resolution No. R-2024-48, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2024-42 TO ACCEPT A BID PROPOSAL FROM SAMRON MIDWEST CONTRACTING FOR RECONSTRUCTION OF ENTRANCES AND CURB REPLACEMENT ALONG EAST SIDE OF SOUTH MAIN STREET
Mayor Spencer presented Resolution No. R-2024-42, a resolution placed on file at the October 28, 2024, regular council meeting, to accept a bid proposal from Samron Midwest Contracting for reconstruction of entrance and curb replacement along east side of South Main Street. Commissioner Peradotta made a motion to approve Resolution No. R-2024-42, which was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ORDINANCE NO. O-2024-12 TO ENTER INTO A PURCHASE CONTRACT FOR THE REAL PROPERTY SOLD AT THE 2024 PERRY COUNTY TAX SALE – 701 PENINA STREET
Mayor Spencer presented Ordinance No. O-2024-12, an ordinance placed on file at the October 28, 2024, regular council meeting, authorizing the City of Pinckneyville to enter into a Purchase Contract for the real property sold at the 2024 Perry County Tax Sale – 701 Penina Street. Commissioner Peradotta made a motion to approve Ordinance No. O-2024-12. The motion seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
MARCIA HAGENE TO DISCUSS WREATHS ACROSS AMERICA
Mayor Spencer introduced Marcia Hagene to discuss Wreaths Across America. She stated Wreaths Across America started in 1992 and became a non-profit organization in 2007. Last year they laid over $3,000,000 wreaths on veterans’ graves across America, and their goal is to be able to provide a wreath for every veteran across the country. She chose to support this case because her late husband who is a veteran is buried at St. Bruno Cemetery. Through advertising on Facebook, in the newspaper, and flyers, they have received enough funds to provide all 169 veterans’ graves at St. Bruno Cemetery with a wreath. This year’s Wreaths Across America Day will take place on December 14, 2024, and she welcomed anyone interested in helping place wreaths to come out that day at 11:00 a.m. She said the American Legion will be present for the ceremony as well. She said Jane Chapman is doing the same for Swanwick Cemetery. She encouraged volunteers to start the same ceremony at all cemeteries next year.
TOM RYAN FROM NEW LEAF ENERGY, INC. – UPDATE AND REQUEST PERMISSION TO MOVE FORWARD WITH SECOND PHASE OF KIWI ROAD 2 COMMUNITY SOLAR PROJECT
Mayor Spencer introduced Tom Ryan from New Leaf Energy, Inc., to provide an update on the Kiwi Road Community Solar Project. He stated Kiwi Road Solar 1 is in the construction phase now as a 2-megawatt system. Kiwi Road Solar 2 will be on the same parcel and will be designed around Kiwi Road Solar 1. There are two leases and they have renewed with a third option and payment was released a few weeks ago. He noted there is no concrete under the solar panels as seen in many other projects, and that they pile drive them with a racking system into the ground. They later plant a native pollinator mix to the area which would be mowed on a schedule after the first couple years of growth. He stated they will pay over $200,000 in property taxes in 20 years, over $67,000 will go to the City of Pinckneyville along with the lease payments.
He asked if he would need another Special Use Permit from the Zoning Board as they did with the Kiwi Road 1 Solar Project. City Attorney Don Bigham stated he looked at the original application with the Zoning Board, and it was for the first phase only, so they would need to apply for the second phase as required by the zoning ordinance. He said a public hearing would be scheduled and they would need to go before the Zoning Board. Mr. Ryan was told to contact Economic Development Coordinator and Zoning Administrator Carrie Gilliam for the application form.
PUBLIC COMMENT
Genevieve Hester thanked the City of Pinckneyville for sponsoring a hole at the Library Golf Scramble on November 3rd. She stated there were 11 teams and 44 people who attended.

Motion by Commissioner Peradotta, seconded by Commissioner Kuhnert to move the meeting to Executive Session at 6:34 p.m. for the discussion of: Section 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee and Section 2 (c) (11) Litigation, pending or probable. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

Motion by Commissioner Peradotta, seconded by Commissioner Kuhnert to return to the regular meeting at 6:41 p.m. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ASSIGN KEVIN ASBURY AS LEAD WORKER FOR THE WATER DEPARTMENT
Commissioner Kuhnert made a motion to assign Kevin Asbury as Lead Worker for the Water Department effective with the start of the current pay period. Commissioner Hicks seconded the request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
