City of Pinckneyville City Council met May 13.

Here is the minutes provided by the council:

ROLL CALL

Mayor Robert L. Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Sammy D. Peradotta, David M. Stone, and Mayor Robert L. Spencer. Commissioner Stotlar was absent. Mayor Spencer declared a quorum present. Commissioner Stone requested to amend the agenda. He requested to table item #2 and #4 under Commissioner Cicardi. Mayor Spencer then announced the agenda was set. Administrative staff present: Deputy Clerk Terri Lindner, City Attorney Don Bigham, Fire Chief Jim Gielow, Economic Development Coordinator Carrie Gilliam, and Police Chief John Griffin. The Pledge of Allegiance was led by Commissioner Stone.

PREVIOUS MINUTES

Motion was made by Commissioner Stone to approve the minutes of the April 22, 2019 regular meeting. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Peradotta, Stone, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

City Treasurer Arthur F. Reese stated that total bank balances were $6,758,101.78. Unrestricted bank balances were $1,380,521.99. Commissioner Peradotta made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Stone. On roll call: Commissioners Hicks, Peradotta, Stone, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Peradotta made a motion to approve the accounts payable. The motion was seconded by Commissioner Stone. On roll call: Commissioners Hicks, Peradotta, Stone, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

None

MOTION TO RECESS

Mayor Spencer requested a motion to recess for approximately 5 minutes to seat the new City Council. Commissioner Peradotta made the motion with Commissioner Hicks seconding it. On roll call: Commissioners Hicks, Peradotta, Stone, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

OATH OF OFFICE FOR MAYOR AND COMMISSIONERS

Attorney Don Bigham administered the Oath of Office to the newly elected City Council: Ricky J. Cicardi, Commissioner of Public Property; Kevin B. Hicks, Commissioner of Public Health and Safety; Sammy D. Peradotta, Commissioner of Streets and Public Improvements; and Robert L. Spencer, Mayor.

CALL TO RECONVENE

Mayor Robert L. Spencer called the meeting to reconvene at 6:08 p.m. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, and Mayor Robert L. Spencer. Commissioner Stotlar was absent. Mayor Spencer declared a quorum present.

NOISE DISTURBANCE COMPLAINT FROM TWISTED VINE

Commissioner Hicks called on Ms. Elaine James to speak to the council about her concern of the noise level coming from the Twisted Vine wine bar. Ms. James stated that she cannot sit in her backyard because of the loud music being played. She has spoke to the police and the mayor several times concerning the matter and they seem frustrated with her. Commissioner Hicks asked Ms. James what she proposed the council to do about it. She stated that she wanted them to enforce the ordinance. She enjoys sitting on her front porch and reading and she can’t do that with the music blaring. She also is taking some online courses and its interfering with that too. She addressed the issue of the lyrics being degrading and not family friendly. At this time Commissioner Hicks asked Brandon Ross the owner of the Twisted Vine to speak. He first apologized to Ms. James for the issues she was having. Mr. Ross stated that they are not open on Sundays addressing a statement that Ms. James said about hearing music on Sundays. He explained that ordinarily they have the music done by 10:00 p.m. He realizes that sometime it runs past. Mr. Ross also questioned Ms. James on what songs she is hearing that is not appropriate. He states that they are a family friendly business and he does not recall any inappropriate music being played. She stated that it is the Top 40 music. Commissioner Hicks stated that the kids listen to it all day on their phones and on the radio. Commissioner Hicks asked Ms. James that the next time she is being disturbed that she should call the police and an officer will be sent down to have them turn the music down. Commissioner Hicks stated that he has had conversation with the Chief of Police and they will go down and address it with them. Ms. James asked if there was a certain decibel that the noise needs to stay below in the ordinance. Chief of Police Griffin stated that the ordinance does not have any such verbiage and that it just states disturbing the peace.

REQUEST FOR STREET SIGNS ALONG W. PARKER STREET

Commissioner Hicks called on Genevieve Hester to speak to the council about her concern with the traffic that is going up and down along W. Parker Street. Ms. Hester presented the council with a copy of a petition she generated that included signatures from residents living on W. Parker and surrounding streets requesting that something be done about the speeding cars. Commissioner Hicks told Ms. Hester that the police have been patrolling that area and giving tickets. He stated that most of the people speeding through there are high school kids. Commissioner Hicks told Ms. Hester that it is a through street so it would be difficult to get a stop sign put up. Commissioner Peradotta said if a speed limit sign or slow children are playing sign is needed, let him know and he would get one ordered. Commissioner Hicks told Ms. Hester that something would be done. She thanked him.

REQUEST TO HIRE STEVE MOODY FOR THE STREET DEPARTMENT

Commissioner Peradotta made a motion to hire Steve Moody to replace Jody Goetting as a part time employee. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PDC LABORATORY PROFESSIONAL SERVICES AGREEMENT

Commissioner Cicardi requested council approval to sign the PDC Laboratory Professional Services Agreement for the contract period July 1, 2019 through June 30, 2020. Commissioner Cicardi explained that this company has been the company that has been testing the city’s water for the past few years. Attorney Bigham explained that since we are entering into an agreement that this would have to be placed on file and approved at the next meeting. Commissioner Cicardi made a motion to place on file approval to sign a service agreement with PDC Laboratory Professional Services for a period of one year. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST TO PURCHASE PAINT FOR THE GUTTERS AT BENDER POOL

Commissioner Cicardi made a request to purchase paint for the gutters at Bender Pool. Commissioner Cicardi mentioned that it was the 50th anniversary of Bender Pool and he wanted it looking nice. Commissioner Cicardi made a motion to purchase the paint. The motion was seconded by Commissioner Peradotta. On roll call: Commissioner Cicardi, Hicks, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT

Motion by Commissioner Cicardi, seconded by Commissioner Hicks to adjourn the meeting at 6:32 p.m. On roll call: Commissioners Cicardi, Hicks, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
