ROLL CALL

Mayor Robert L. Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa S. Kellerman, City Attorney Don Bigham, Police Chief Kenny Kelley, and Fire Chief Jim Gielow. Due to the COVID-19 Pandemic, the public was invited to attend by social distancing in the lobby area and the Council Chambers of City Hall or by calling in on a conference line. The Pledge of Allegiance was led by Commissioner Peradotta.

PREVIOUS MINUTES

Motion was made by Commissioner Hicks to approve the public hearing and regular council meeting minutes of the April 27, 2020. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that the ending bank balance total was $5,850,232.11 for the period ending April 30, 2020, down from last year. Unrestricted balance total was $1,472,577.06, which is up from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi noted that the Pinckneyville Nursing and Rehabilitation Center will be having a drive-by parade Wednesday, May 13, 2020, at 2:00 p.m. Residents will be brought outside the facility while family, friends, and the community drive-by. Everyone is asked to stay at least 6 feet away during the drive-by to promote social distancing. Cars are asked to line up at 1:30, entering the north fairground gate by the Thresherman Museum and proceed through the fairgrounds to the south gate on Murphy Road, turning left to go by the pool.

RESOLUTION NO. R-2020-17 AUTHORIZING A LEASE OF REAL ESTATE OWNED BY THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS TO COLLIN HIRSCH FOR AGRICULTURAL PURPOSES

Commissioner Cicardi introduced Resolution No. R-2020-17, a resolution to be placed on file, authorizing a lease of real estate owned by the City of Pinckneyville, Perry County, Illinois to Collin Hirsch for agricultural purposes. This is property that used to be farmed by Mr. Bruns and is 5.9 acres near the lift station. Commissioner Cicardi made a motion to place on file Resolution No. R-2020-17. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2020-14 TO AWARD AND AUTHORIZE A CONTRACT WITH SAMRON MIDWEST CONTRACTING INC. FOR SIDEWALK IMPROVEMENTS IN THE CITY OF PINCKNEYVILLE

Commissioner Peradotta presented Resolution No. R-2020-14, a resolution placed on file at the April 27, 2020, regular council meeting, to award and authorize a contract with Samron Midwest Contracting Inc. for sidewalk improvements in the City of Pinckneyville. He stated the work must be completed by June 30, 2020. Commissioner Peradotta made a motion to approve Resolution No. R-2020-14. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST APPROVAL TO HIRE PART-TIME SUMMER HELP

Commissioner Peradotta requested approval to hire part-time summer help at $10.00 per hour. He requested to hire Charlie Davis, to replace Daron Chandler, who decided not to accept the position previously approved at the April 27, 2020, regular council meeting. He stated he will be worked 2-3 days per week to assist while other full-time workers are off during the summer months. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, and Stotlar voted YEA. NAYS: None. ABSTAINED: Mayor Spencer. Motion declared carried.

RESOLUTION NO. R-2020-19 APPROVING AND AUTHORIZING TO AN ADDENDUM TO THE AGREEMENT WITH MUTUAL MEDICAL PLANS, INC., TO SERVE AS THIRD PARTY ADMINISTRATOR OF CITY’S HEALTH INSURANCE PLAN

Commissioner Stotlar introduced Resolution No. R-2020-19, a resolution to be placed on file, approving and authorizing to an addendum to the agreement with Mutual Medical Plans Inc., to serve as third party administrator of the City’s Health Insurance Plan. Commissioner Stotlar stated the current plan expires on May 31, 2020, and proposed to renew the City’s self-funded health insurance plan for one year, agreeing to a new administration fee of $35.00 per employee per month starting June 1, 2020. Commissioner Stotlar made a motion to place on file Resolution No. R-2020-19. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2020-20 TO AUTHORIZE THE STOP LOSS INSURANCE RENEWAL FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, HEALTH CARE PLAN

Commissioner Stotlar introduced Resolution No. R-2020-20, a resolution to be placed on file, to authorize the Stop Loss Insurance renewal for the City of Pinckneyville, Perry County, Illinois, Health Care Plan. Commissioner Stotlar explained this insurance provides insurance coverage for medical expenses incurred by plan participants above the selected individual deductible amount and aggregate specific deductible amount. The current plan expires on May 31, 2020. Commissioner Stotlar proposed to renew the City’s Stop Loss Insurance plan for one year, choosing Plan C, which offers a $45,000 Individual Stop Loss Deductible and a $15,000 Aggregate Specific Deductible starting June 1, 2020. This plan will keep the annual premium the same as last year. Commissioner Stotlar made a motion to place on file Resolution No. R-2020-20. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2020-15 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO AN ADDENDUM TO THE COLLECTIVE BARGAINING AGREEMENT WITH THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, SOUTHERN AND CENTRAL ILLINOIS LABORERS’ DISTRICT COUNCIL LOCAL 773

Mayor Spencer presented Resolution No. R-2020-15, a resolution placed on file at the April 27, 2020, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an addendum to the Collective Bargaining Agreement with the Laborers’ International Union of North America, Southern and Central Illinois Laborers’ District Council Local 773. Commissioner Peradotta made a motion to approve Resolution No. R-2020-15. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2020-18 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO AN AGREEMENT TO OBTAIN PRESCRIPTION MEDICATIONS FOR CITY EMPLOYEES AND COVERED DEPENDENTS THROUGH STOTLAR DRUG COMPANY

Mayor Spencer introduced Resolution No. R-2020-18, a resolution to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an agreement to obtain prescription medications for City employees and covered dependents through Stotlar Drug Company. Attorney Bigham stated that Commissioner Stotlar had previously reported the substantial mark-up on drugs through Express Scripts. Mayor Spencer stated this option to use Stotlar Drug Company provides potential savings to the employee and the City. Employees would have no co-pay for generic prescriptions and only a $15 co-pay for name brand prescriptions. The City would pay any generic drug costs plus a $5 processing fee or name brand drug costs plus a $10 handling charge. Any drug cost that exceeds $500 would be processed as a claim with the health insurance plan with the patient being responsible for any co-pay required by the plan. Stotlar Drug Company will bill the City monthly. This is available to all employees that have City insurance as their primary insurance plan. Any employee who has the MRP plan as a supplemental insurance plan would continue to turn in their bills to the City for co-pay reimbursement through Mutual Medical. Employees and their dependents still have the option to use a different pharmacy or Express Scripts’ mail order program if they wish. Attorney Bigham stated this must be ran by the Unions Representatives before it can be offered to Union employees, but would be available to non-union employees with the effective date of the agreement of June 1, 2020. Commissioner Cicardi made a motion to place on file Resolution No. R-2020-18. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, and Mayor Spencer voted YEA. NAYS: None. ABSTAINED: Commissioner Stotlar. Motion declared carried.

REAPPOINT TED HARSHA TO THE POLICE PENSION BOARD

Mayor Spencer requested a motion to reappoint Ted Harsha to the Police Pension Board. Commissioner Hicks made a motion to reappoint Ted Harsha to the Police Pension Board. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

DISCUSS DECREASE IN REVENUE DUE TO COVID-19

Mayor Spencer presented the Council with a spreadsheet of the estimated decrease in utilities revenue for March and April 2020. The decrease in usage in March calculated to an estimated decreased revenue of $57,250.45 for March 2020, and $19,181.61 for April 2020, during the COVID-19 “Stay at Home” Order. Mayor Spencer also stated that video gaming tax was approximately $15,000 for the period March-May 2019, and this year is at $2,500 for the same months. Illinois Municipal League has estimated the following tax losses during COVID-19: Personal Property Replacement Tax – 30%; Local Government Distributive Funds – 15%; and Motor Fuel Tax (due to reduced traffic and gas consumption) – 15%. Mayor Spencer estimates a loss in Revenue of $350,000 - $500,000 if COVID-19 continues through July. Commissioner Stotlar stated CPA Pat Kattenbraker e-mailed him estimating a loss of $450,000 due to decreased revenue including income tax, which won’t be received until next year. He also stated he feels the City is “in the black” with less liabilities including the new water meter payment of about $10,000 per month. Mayor Spencer reiterated there is no way to reclaim lost revenue. Commissioner Hicks asked what the solution would be. Mayor Spencer stated cutting back, no unnecessary purchases. Commissioner Cicardi stated the prison causes a hardship to the sewer pumps with the bleach and other chemicals through the system, along with abnormal items being flushed. He stated the City has a contract with the prison, but they won’t respond to him. Commissioner Hicks asked if other prisons had the same issues, and Commissioner Cicardi stated he had talked to the Mayor of Chester, and they fight the same battle. Mayor Spencer stated some items like emergency purchases must still pass, so he is trying to get ahead of things by cutting other unnecessary purchases. He is trying to avoid layoffs down the line by getting ahead of the situation. Commissioner Cicardi stated the remaining Zenner commercial water meters should start to be installed this month, but there will still be some gas meters left to install. Mayor Spencer stated he had hoped to pay the meter loan off in five years, but structured it for ten years, and may need to use all of that due to decreased revenues. Commissioner Stotlar stated the accounts look good until things get back to normal. He said we need to continue

to operate strategically and smart, but he is more concerned about the State not paying us. Mayor Spencer indicated they will be slow with everything going on. He said he wants to make sure we continue to stay in good shape for any future obligations the City may have come up. Commissioner Cicardi stated no one wants to spend tax payer money, and the council is all aware. He thinks sales tax will be okay. Commissioner Hicks stated it’s better to be safe. Mayor Spencer then passed out the 5-Phase Restore Illinois Plan, indicating we are now in Phase 2 and hoping to be in Phase 3 by the end of the month. The handout from Illinois Economic Development Association explains the criteria to get to the next phase. Mayor Spencer also stated 15 businesses applied for the new Downstate Small Business Stabilization Grant. Five qualified and there will have to be a public hearing after a notice is published in the Press. Commissioner Cicardi stated the pool has been cleaned and power-washed and will be filled this week to prepare it for the possibility of opening soon.
