City of Pinckneyville City Council met June 22.

ROLL CALL

Commissioner Stotlar called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks and Commissioner William B. Stotlar. Commissioner Stotlar requested permission for Commissioner Peradotta and Mayor Spencer to attend the meeting by phone. Commissioner Cicardi made the motion, seconded by Commissioner Hicks to allow their attendance by phone. On roll call: Commissioners Cicardi, Hicks, and Stotlar voted YEA. NAYS: None. Motion declared carried and Commissioner Peradotta and Mayor Spencer joined the meeting by phone. Commissioner Stotlar declared a quorum present. Commissioner Stotlar announced the agenda was set. Administrative staff present: City Clerk Melissa S. Kellerman, City Attorney Don Bigham, Police Chief Kenny Kelley, Fire Chief Jim Gielow, and Economic Development Coordinator Carrie Gilliam. Due to the COVID-19 Pandemic, the public was invited to attend by social distancing in the lobby area and the Council Chambers of City Hall or by calling in on a conference line. The Pledge of Allegiance was led by Commissioner Cicardi.

PREVIOUS MINUTES

Commissioner Stotlar noted that the minutes of the Public Hearing of June 8, 2020, were not provided in the council packets, but were provided to the council members prior to this meeting. Motion was made by Commissioner Cicardi to approve the minutes of both the June 8, 2020, regular council meeting and June 8, 2020, Public Hearing. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that the ending bank balance total was $6,281,372.05, and unrestricted balance total was $1,603,443.85, for the period ending May 31, 2020, both up from last year. Commissioner Hicks made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar added an invoice from NewWave for $138.93 to the accounts payable. Commissioner Peradotta made a motion to approve the accounts payable with the additional invoice. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi stated the Vintage in the Ville would be held Saturday, June 27th from 9 a.m. to 3 p.m. at the Pinckneyville Fairgrounds.

Commissioner Peradotta stated that oil and chipping of streets had started and would continue the next two days.

ORDINANCE NO. O-2020-16 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO A LEASE ON THE PREMISES AT 5512 STATE ROUTE 154, PINCKNEYVILLE, ILLINOIS, WITH PERRY-JACKSON COUNTY CHILD ADVOCACY CENTER

Commissioner Cicardi presented Ordinance No. O-2020-16, an ordinance placed on file at the June 8, 2020, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a lease on the premises at 5512 State Route 154, Pinckneyville, Illinois, with Perry-Jackson County Child Advocacy Center. This is a 3-year lease renewal.

Commissioner Cicardi made a motion to approve Ordinance No. O-2020-16. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST APPROVAL FOR FIRST BAPTIST CHURCH TO CLOSE CITY STREET

Commissioner Hicks stated that First Baptist Church is requesting to close St. Louis Street from Mill Street to the end of their parking lot the evenings of July 20-24, 2020, from 6:00-7:30 p.m. for their 5-day Club (Vacation Bible School). Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2020-19 ENACTING AND ADTOPTING A SUPPLEMENT TO THE CODE OF ORDINANCE FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Commissioner Stotlar presented Ordinance No. O-2020-19, an ordinance enacting and adopting a supplement to the Code of Ordinance for the City of Pinckneyville, Perry County, Illinois. Commissioner Cicardi made a motion to approve Ordinance No. O-2020-19. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2020-25 AUTHORIZING A LEASE OF OFFICE SPACE TO THE UNIVERISTY OF ILLINOIS EXTENSION

Commissioner Stotlar introduced Resolution No. R-2020-25, a resolution to be placed on file, authorizing a lease of office space to the University of Illinois Extension. Attorney Bigham stated the Extension Service asked for the following changes to the lease agreement: (1) The City would pay the contractors when work was done and the Extension Service would reimburse the City by increasing their monthly rent over the course of twelve months; (2) The City has the right to accept and authorize bids for remodeling. Commissioner Peradotta made a motion to place on file Resolution No. R-2020-25. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPROVAL AND ACCEPTANCE OF BID FOR REMODELING WORK ON COMMUNITY CENTER FROM JENKEL PAINTING

Commissioner Stotlar presented a bid in the amount of $4,000.00 from Jenkel Painting for remodeling work on the Community Center. Commissioner Cicardi made the motion to approve and accept the bid. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPROVAL AND ACCEPTANCE OF BID FOR REMODELING WORK ON COMMUNITY CENTER FROM JOHN DUDEK

Commissioner Stotlar presented a bid in the amount of $1,550.00 from John Dudek for remodeling work on the Community Center. Commissioner Peradotta made the motion to approve and accept the bid. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2020-18 AUTHORIZING APPROVAL OF BUSINESS DISTRICT GRANT FROM JOSHUA L. BAGLEY AND GRANDMA’S COFFEE AND CAKES, LLC

Commissioner Stotlar presented Ordinance No. O-2020-18, an ordinance authorizing approval of an application from Joshua L. Bagley and Grandma’s Coffee and Cakes, LLC, for business district funds and committing business district funds from the City of Pinckneyville, Perry County, Illinois. Economic Development Coordinator Carrie Gilliam stated this is a $25,000 Business District Funds Grant. Mr. Bagley stated he is waiting on bids before applying for the Façade Improvement Grant. He stated the timeline to open is July 21, 2020, and that the grant would be used for plumbing and electrical work. He stated bathrooms will be added, a new breaker box, and 1” water line. He plans to have two additional staff members besides himself and stated they collectively have over 20 years of coffee and bakery business experience. His business will occupy the old McCants building at 3 and 5 North Main Street. The bakery will be in 5 North Main and 3 North Main will be available for a future business. Commissioner Cicardi made a motion to approve Ordinance No. O-2020-18. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2020-20 AMENDING CHAPTER 110 OF THE CODE OF ORDINANCES OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, REGARDING ALCOHOLIC BEVERAGES

Commissioner Stotlar presented Ordinance No. O-2020-20, an ordinance amending Chapter 110 of the Code of Ordinances of the City of Pinckneyville, Perry County, Illinois, regarding alcoholic beverages. Attorney Bigham stated this includes the recent amendment to the State Liquor Code for the sale of curbside mixed drinks and has a one year term with the same conditions and requirements as the State to expire in one year. Commissioner Peradotta made a motion to approve Ordinance No. O-2020-20. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

SOUTHERN ILLINOIS AGGREGATION PARTNERSHIP MUNICIPALITY POWER OF ATTORNEY

Commissioner Stotlar presented the Southern Illinois Aggregation Partnership Municipality Power of Attorney along with a current price sheet that was delivered by e-mail that afternoon. Attorney Bigham stated that the current agreement expires in December 2020. This Power of Attorney allows Select Energy Partners, LLC to act as agent, as they have before, to solicit for bids of power supplies. The quote sent has lower rates than the prior contract. Commissioner Cicardi asked if there was an agent fee for this service. Attorney Bigham stated they do get a fee that comes from the energy supplier. Commissioner Stotlar asked who had provided the energy in prior years. Mayor Spencer stated Constellation had the lowest price during the last three year contract. Mayor Spencer stated that Homefield had the lowest prices on the last report, but another price sheet was to come before the meeting. This current price sheet provided today shows AEP as the lowest price. Mayor Spencer recommended a three year term to lock in the rates. Commissioner Hicks made a motion to approve the Southern Illinois Aggregation Partnership Municipal Power of Attorney for a three year term. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT TO EXECUTIVE SESSION

Motion by Commissioner Cicardi, seconded by Commissioner Hicks to move the meeting to Executive Session at 6:34 p.m. for the discussion of: Section 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee and Section 2 (c) (2) Collective negotiating matters or deliberations concerning salary schedules. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RETURN TO REGULAR MEETING

Motion by Commissioner Peradotta, seconded by Commissioner Cicardi to return to the regular meeting at 7:32 p.m. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PUBLIC COMMENTS

Josh Giacomo from the Thresherman’s Association stated they will have insurance coverage when the state goes into Phase 4 of Restore Illinois and asked about holding their annual event in August. He understands the have to follow the guidelines of groups of 50 people six feet apart. Commissioner Cicardi asked if they had some type of plan since they know they will have hundreds of people and he suggested they contact the health department. Mayor Spencer stated they should wait for the Governor to announce we are in Phase 4 on June 26, then start developing a plan to move forward, talk to the health department, so they can move to a plan. Commissioner Peradotta stated Phase 4 allows for groups of 50 people or less. Commissioner Cicardi stated the council was all in, the Thresherman’s Association just needed to set up a plan for separating groups of 50 people. Commissioner Stotlar interjected groups of 50 people 30 feet apart. Josh stated the event is held the third week of August, so August 14-17. Their next meeting is July 11, 2020, so he wanted to present something at the meeting so they could make the call. Josh said on Friday-Saturday they could have 5,000-6,000 people out there, but their always spread out and it’s outside.
