ROLL CALL
Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, and Fire Chief Jim Gielow. The Pledge of Allegiance was led by Commissioner Stotlar.
PREVIOUS MINUTES
Commissioner Peradotta made a motion to approve the minutes of the April 25, 2022, public hearing and the April 25, 2022, regular council meeting. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
TREASURER’S REPORT
Commissioner Stotlar reviewed the treasurer’s report and stated that Total Gross Payroll was $616,898.16 for the payroll period ending April 2022, up from last year. He stated that the regular hours of 22,534.50 were down from last year and overtime hours of 856 were up from last year primarily in the police and utility departments. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ACCOUNTS PAYABLE
Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
CORRESPONDENCE
Commissioner Peradotta reminded the public that oil and chipping of certain city streets will be June 6, 7, and 8, weather permitting. The area to be treated will be East of the Dairy Queen, Grecian Steakhouse and Trophy Room toward the high school and junior high and South of the Perry County Jail. Other streets to be treated outside this area will be Lookout, Fallon, West Randolph Streets, the alley between Grant and Fallon Street, everything west of Grant Street towards the railroad tracks, as well as parking lots in the fairground area, and finishing Fairground Road from Malone Street south to the city limits by Charlotte Hills.
City Clerk Melissa Kellerman read an e-mail addressed to Mayor Spencer dated May 6, 2022, from Cari Wallace: “On behalf of the Wallace family, I would like to thank you for your efforts in securing approval for a memorial event and plaque in my family's honor at Pinckneyville Lake. After speaking with my family, we have decided to postpone the event to next July 2023, in order to properly plan, as well as secure the actual plaque to be placed at the lake.
I will continue to keep you updated on our plans, as they materialize. Thank you again for your role in bringing this story to life. I look forward to continued collaboration on this momentous event!”
RESOLUTION NO. R-2022-23 TO ENTER INTO A CERTIFIED WATER OPERATOR SERVICES AGREEMENT WITH HMG INFRASTRUCTURE SERVICES, LLC
Commissioner Cicardi presented Resolution No. R-2022-23, a resolution placed on file at the April 25, 2022, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Certified Water Operator Services Agreement with HMG Infrastructure Services, LLC. He stated the City is able to cut back the hours provided by HMG because the City hired a Certified Water Operator. Commissioner Cicardi made a motion to approve Resolution No. R-2022-23. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
PURCHASE GRASSHOPPER 727DT MOWER WITH 3661 PF FROM DIEDRICH IMPLEMENT
Commissioner requested approval to purchase a Grasshopper 725DT mower with 3661PF from Diedrich Implement in Nashville, Illinois, at a cost of $14,933.82. This one was the lowest bid. Diedrich Implement stated it will be two to three weeks before the mower will arrive, but they would provide a loaner during that time. He stated his department has more to mow since less is being contracted out, and he currently has two mowers with mechanical issues. Commissioner Hicks asked if it was less expensive for the City workers to mow than using contractors. Commissioner Cicardi responded he didn’t have all the numbers, but that it probably was because he uses part-time workers, plus the City would hopefully get twenty years of use out of the mowers. Commissioner Stotlar asked if he could borrow a mower from the Street Department. Commissioner Peradotta responded that since it’s been wet, neither department has had time to mow and both are busy trying to keep up, so all mowers are in use. Commissioner Cicardi made a motion to approve the purchase which was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. REQUEST TO CLOSE A PORTION OF WEST JACKSON STREET FOR FARMER’S/VENDOR MARKET JUNE 4, 2022, JULY 2, 2022, AUGUST 6, 2022, SEPTEMBER 3, 2022, AND OCTOBER 1, 2022
Tara Conner, of Sweet Leona’s, and Brooklyn Hurst, of Victory Clothing, requested to close a portion of West Jackson Street, from North Main Street to North Walnut Street, for a Farmer’s/Vendor Market on the following Saturdays from 9:00 a.m. to 2:00 p.m.: June 4, 2022, July 2, 2022, August 6, 2022, September 3, 2022, and October 1, 2022. Commissioner Peradotta suggested the barricades be put up by 8:00 a.m. so that no one parks in that area. Motion by Commissioner Hicks, seconded by Commissioner Cicardi to approve the request. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
REQUEST TO DISCUSS YARD MAINTENANCE AT 105 WEST GRAND AVENUE
Ron and Sheila King requested to discuss yard maintenance at 105 West Grand Avenue. Sheila provided pictures of the property and stated there is traffic and people fighting at all hours and rodents in her yard due to the overgrowth of the neighbor’s property. She has been trying to sell her mother’s home across the street, but no one will look at it because of the neighbor’s property. She would appreciate the Council getting the property cleaned up and said the owner should be fined. The Mayor and Commissioners indicated they had all driven by the property. Commissioner Hicks told her she needed to follow the chain of command and first contact the police, then him as Commissioner of Public Safety and Health, then the Mayor, then the Council. She stated she had been to the police department several times in the past, but not lately. Commissioner Hicks stated a citation would be written the next day. Mayor Spencer had notes from the police department that went back five years, and stated he was sorry and that something will be done.
RESOLUTION NO. R-2022-25 APPROVING A HEALTH INSURANCE ASSISTANCE PLAN (HIAP)
Commissioner Stotlar presented Resolution No. R-2022-25, a resolution approving a Health Insurance Assistance Plan (HIAP) for the City of Pinckneyville, Perry County, Illinois. Commissioner Stotlar made a motion to approve Resolution No. R-2022-25. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
ORDINANCE NO. O-2022-11 AUTHORIZING THE APPROVAL OF AN APPLICATION FROM PLACE REAL ESTATE, FOR BUSINESS DISTRICT FUNDS AND COMMITTING BUSINESS DISTRICT FUNDS FROM THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS
Mayor Spencer presented Ordinance No. O-2022-11, an ordinance authorizing the approval of an application from Place Real Estate, for Business District Funds and Committing Business District Funds from the City of Pinckneyville, Perry County, Illinois. Cheryl Bigham gave a presentation at the last council meeting regarding the building renovation project. This Ordinance is for half of the total renovation cost up to $25,000.00. Commissioner Hicks made a motion to approve Ordinance No. O-2022- 11. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
RESOLUTION NO. R-2022-24 TO ENTER INTO A TASK ORDER AGREEMENT FOR ENGINEERING SERVICES WITH HMG IN CONNECTION WITH WATER AND SEWER LINE RELOCATION
Mayor Spencer presented Resolution No. R-2022-24, a resolution placed on file at the April 25, 2022, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Task Order Agreement for engineering services with HMG in connection with Water and Sewer Line Relocation. Commissioner Cicardi made a motion to approve Resolution No. R-2022-24. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
APPOINT JUDIE HASTINGS TO PINCKNEYVILLE PUBLIC LIBRARY BOARD
Mayor Spencer requested to appoint Judie Hastings to the Pinckneyville Public Library Board to replace the vacancy left by Londa Campbell. Motion by Commissioner Cicardi, seconded by Commissioner Stotlar to appoint Judie Hastings to the Pinckneyville Public Library Board. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
PUBLIC COMMENT
Tina Jausel addressed the council regarding the additional storage building to be built at the Caring and Sharing Thrift Store. It is her understanding they intend to build the building four feet from the sidewalk on Ozburn Street, which will block the view from her driveway when exiting. She said the street gets busy with patrons of the store, and she’s concerned she will have to pull out into the street in order to see to exit her driveway. She’s also concerned it will affect the resale of her house. She had spoken to Paul Pyatt and he told her that is where the building will be placed. She has spoken to the zoning committee and Economic Development Coordinator Carrie Gilliam and is now asking the City Council for assistance to request them to set the building back five more feet. Commissioner Hicks asked if she had any recourse. City Attorney Don Bigham said the thrift store could consider alternate plans. He said the City can address public safety on streets, but not a private driveway. He said she could request to buy a visibility easement to not block the view or hire an attorney. She stated she didn’t want to do that because they do a lot for the community and she supports them. She asked if there were any zoning issues when a commercial property is adjoining a residential property. Mayor Spencer stated the zoning goes up to the sidewalk. Ms. Jausel stated she’s only asking for five feet, which shouldn’t hurt their storage much.
