ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Ricky J. Cicardi, Kevin B. Hicks, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. City Attorney Don Bigham requested to add Executive Session for the discussion of Section 2 (c) (2) Collective negotiating matters or deliberations concerning salary schedules. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, Fire Chief Jim Gielow, and Economic Development Coordinator Carrie Gilliam. The Pledge of Allegiance was led by Commissioner Peradotta.

PREVIOUS MINUTES

Commissioner Peradotta made a motion to approve the minutes of the April 11, 2022, regular council meeting. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that the ending balance total for the period ending March 2022 was $9,081,402.23 up from last year, and unrestricted balance total was $1,879,631.80 also up from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Cicardi asked Cheryl Bigham to speak on behalf of the Perry County Historical Society’s Vintage Market in the Ville. The event will be Friday, May 6th 3:00 p.m. to 8:00 p.m. and Saturday, May 7th 9:00 a.m. to 3:00 p.m. at the Perry County Fairgrounds under the grandstand in case of rain. There will be vendors and food trucks on site. Admission will be $2.00 per person.

Commissioner Peradotta gave notice that oil and chipping of certain city streets will be June 6, 7, and 8, weather permitting. The area to be treated will be East of the Dairy Queen, Grecian Steakhouse and Trophy Room toward the high school and junior high and South of the Perry County Jail. Other streets to be treated outside this area will be Lookout, Fallon, West Randolph Streets, the alley between Grant and Fallon Street, everything west of Grant Street towards the railroad tracks, as well as parking lots in the fairground area, and finishing Fairground Road from Malone Street south to the city limits by Charlotte Hills.

ORDINANCE NO. O-2022-07 TO ENTER INTO A CONTRACT WITH CWI OF ILLINOIS, INC. TO ACCEPT AND PROCESS LEACHATE

Commissioner Cicardi presented Ordinance No. O-2022-07, an ordinance placed on file at the April 11, 2022, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a contract with CWI of Illinois, Inc., to accept and process leachate. Commissioner Cicardi made a motion to approve Ordinance No. O-2022-07. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-20 TO ENTER INTO A SWIMMING POOL MANAGEMENT SERVICE AGREEMENT FOR THE MANAGEMENT OF THE CITY POOL

Commissioner Cicardi presented Resolution No. R-2022-20, a resolution placed on file at the April 11, 2022, regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a swimming pool management service agreement for the management of the City Pool with Cheryl Clark. Commissioner Cicardi stated the pool is set to open May 21, 2022, and made a motion to approve Resolution No. R-2022-20. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PURCHASE TRASH CAN LINERS FOR PARK FROM SHELBY COUNTY COMMUNITY SERVICES, INC.

Commissioner Cicardi requested approval to purchase 40 cases of heavy duty trash can liners for the park from Shelby County Community Services, Inc., at a total cost of $2,600.80. Commissioner Cicardi made a motion, which was seconded by Commissioner Stotlar, to approve the purchase. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CHANGE ORDER NO. 1 AND PAY APPLICATION NO. 1 FOR IL-154 WATER MAIN EXTENSION PROJECT FROM HAIER PLUMBING & HEATING, INC.

Commissioner Cicardi made a motion to approve Change Order No. 1 and Pay Application No. 1 for the IL-154 Water Main Extension Project from Haier Plumbing & Heating, Inc. He stated there were additional boring materials needed which totaled $2,950.00. Commissioner Peradotta seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

BID FROM JENKEL PAINTING FOR CLEANING AND PAINTING THE JAKE BENTER MUNICIPAL POOL

Commissioner Cicardi presented a bid from Jenkel Painting for cleaning and painting the Jake Bender Municipal Pool at a total cost of $5,500.00. He stated the paint has already been purchased. Commissioner Cicardi made a motion to approve the bid. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PCHS ATHLETIC DIRECTOR BOB WAGGONNER REQUESTED TO DISCUSS ASSISTANCE FROM CITY TOWARD COST OF THE BASEBALL/SOFTBALL SCOREBOARDS

Athletic Director, Bob Waggoner, thanked the City for supporting projects throughout the year. He stated that purchase of the scoreboards is on their agenda for approval at tonight’s meeting at a cost of $7,995 each for a total cost of $15,990 for the two scoreboards, not including installation, and requested the City to assist with 50% of the cost and to help with installation. The other 50% will come from PCHS and feeder schools. The new scoreboards will be LED and wireless. He stated the school would donate the two current scoreboards to the other two fields at the park. Four working scoreboards would help with tournaments. Commissioner Cicardi made a motion to make a contribution of 50% of the cost of the scoreboards or $8,000.00. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-23 TO ENTER INTO A CERTIFIED WATER OPERATOR SERVICES AGREEMENT WITH HMG INFRASTRUCTURE SERVICES, LLC

Commissioner Cicardi introduced Resolution No. R-2022-23, a resolution to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Certified Water Operator Services Agreement with HMG Infrastructure Services, LLC. He stated the City hired a Certified Water Operator one month ago, and HMG has been helping him with the water samples. With this revised agreement, HMG will come 10 hours per month to assist and oversee the sampling at a cost of $1,375 per month for 10 hours. Mayor Spencer asked about the term of the contract and if it could be extended. Commissioner Cicardi stated it would be from May 1, 2022, to April 30, 2023. City Attorney Don Bigham stated he reviewed the agreement, and stated it can be extended or terminated at any time as long as the payment is up-to-date. Commissioner Cicardi made a motion to place on file Resolution No. R-2022-23. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-08 APPROVING THE ESTIMATE OF REVENUES FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, FOR THE FISCAL YEAR ENDING APRIL 30, 2023

Commissioner Stotlar presented Ordinance No. O-2022-08, an ordinance placed on file at the April 11, 2022, regular council meeting, approving the Estimate of Revenues for the City of Pinckneyville, Perry County, Illinois, for the fiscal year ending April 30, 2023. Commissioner Stotlar made a motion to approve Ordinance No. O-2022-08. Commissioner Cicardi seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-09 TO ADOPT THE ANNUAL BUDGET FOR THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS FOR THE FISCAL YEAR ENDING APRIL 30, 2023

Commissioner Stotlar presented Ordinance No. O-2022-09, an ordinance placed on file at the April 11, 2022, regular council meeting to adopt the Annual Budget for the City of Pinckneyville, Perry County, Illinois, for the fiscal year ending April 30, 2023. Commissioner Stotlar made a motion to approve Ordinance No. O-2022-09. Commissioner Hicks seconded the motion. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PROPOSALS FOR NEW KITCHEN CABINETS AND FLOORING FOR CITY HALL KITCHEN FROM WRITE BUILDING CENTER AND MCDANIEL’S FURNITURE

Commissioner Stotlar requested approval of two proposals for new kitchen cabinets and flooring for the City Hall kitchen. He received a proposal from Wright Building Center for wood cabinets at a total cost of $3,930.23 and a proposal from McDaniel’s Furniture for vinyl flooring at a total cost of $1,308.00. He stated the metal kitchen cabinets are original to the building and are rusting. Commissioner Stotlar made a motion to approve the two proposals. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-06 AMENDING “AN ORDINANCE AUTHORIZING A LICENSE AND IMPOSING A FEE FOR VIDEO GAMING ESTABLISHMENTS AND TERMINALS IN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS”

Mayor Spencer presented Ordinance No. O-2022-06, an ordinance placed on file at the March 28, 2022, regular council meeting, amending “An Ordinance Authorizing a License and Imposing a Fee for Video Gaming Establishments and Terminals in the City of Pinckneyville, Perry County, Illinois.” He stated the original ordinance, O-2017-03, established a fee of $25 per license for each video gaming terminal in the licensed establishment, and that this amendment would increase that fee to $100 per license for each video gaming terminal starting May 1, 2022, and then increase the fee again to $150 per license for each video gaming terminal effective May 1, 2023. Commissioner Peradotta made a motion to approve Ordinance No. O-2022-06. The motion was seconded by Commissioner HIcks. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2022-11 AUTHORIZING THE APPROVAL OF AN APPLICATION FROM PLACE REAL ESTATE, FOR BUSINESS DISTRICT FUNDS AND COMMITTING BUSINESS DISTRICT FUNDS FROM THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Due to the project limit needing to be amended, this Ordinance was tabled until the next regular council meeting. However, since Cheryl Bigham was present at this meeting, she gave a summary of the work done at her business. She stated there were structural issues with the floor in the building which further led to issues with the walls. They took this opportunity to renovate all of the interior to maintain and preserve the building.

ORDINANCE NO. O-2022-12 APPROVING AMENDMENTS TO THE AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, ILLINOIS AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR REALIGNMENT OF ILLINOIS STATE ROUTE 127

Mayor Spencer presented Ordinance No. O-2022-12, an ordinance approving amendments to the agreement between the City of Pinckneyville, Illinois and the Illinois Department of Transportation for realignment of Illinois State Route 127. City Attorney Don Bigham stated this addresses some mistakes in measurements on the original documents that didn’t match the survey plats. The changes are in the area that will come back to the City’s control on Illinois State Route 127 south of the courthouse. Commissioner Hicks made a motion to approve Ordinance No. O-2022-12. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2022-24 TO ENTER INTO A TASK ORDER AGREEMENT FOR ENGINEERING SERVICES WITH HMG IN CONNECTION WITH WATER AND SEWER LINE RELOCATION

Mayor Spencer introduced Resolution No. R-2022-24, a resolution to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a Task Order Agreement for engineering services with HMG in connection with Water and Sewer Line Relocation. Jesse Maynard of HMG Engineering stated this is in preparation for Illinois State Route 127 project. In IDOT’s final plans, they found the following: 1. Four sections of water main need relocated or encased and HMG will start on the designs for this part of the project. IDOT has agreed to pay for the crossing at Laurel Street. 2. The City has a gravity sewer line from North Street to Jackson Street and Dairy Queen to Grand Avenue. IDOT proposes the City move the sewer out of the center of the highway to the proposed bike lane. The current sewer line is clay and has caused issues in the past. The first step is to have a survey to see if the sewer can be moved to the new bike lane. The survey will cost $24,000, which will come off the HMG design fee if the City chooses to do the project. IDOT requires 11” of pavement over the sewer line, then they will mill and resurface. Jesse said they would need help from the City with flagging during the survey period. Commissioner Hicks asked if the cost was actually $1,200,000. Jesse said they might be able to request from IDOT to do a lesser amount of pavement over the sewer if it is in the bike lane. Commissioner Hicks asked if the City had to replace the sewer. Jesse replied that if not done prior to the new highway and the sewer would later collapse, the highway would have to be torn up and replaced at the City’s cost. He said there are already problems with the sewer lines now. Mayor Spencer stated either now or later, it still needs done. Commissioner Peradotta said the price could double in the future. Jesse said they could firm up the price once the survey is complete. Commissioner Peradotta said it’s old enough, it needs replaced, and it would be best to move it to the bike lane. Economic Development Coordinator Carrie Gilliam asked if this sewer line was original to the City, and Jesse replied it likely is as it is the main trunk line that runs to the plant. He said it is 3,500 feet of sewer line. He said if the council decides to do it, it must be done soon. Commissioner Peradotta made a motion to place on file Resolution No. R-2022-24. The motion was seconded by Commissioner Cicardi. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPLLY FOR $1,500,000 DCEO PUBLIC INFRASTRUCTURE GRANT

Mayor Spencer, Economic Development Coordinator Carrie Gilliam, and Jesse Maynard of HMG have been looking at this public infrastructure grant which was previously offered in the amount of $550,000, but has been increased to $1,500,000 for one year only. It will be reviewed in October and will probably be for water/wastewater under Health & Safety Risk. Motion by Commissioner Peradotta, seconded by Commissioner Stotlar to apply for the $1,500,000 DCEO Grant. On roll call: Commissioners Cicardi, Hicks, Peradotta, Stotlar and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
