City of Pinckneyville City Council met July 24.

Here are the minutes provided by the council:

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Mayor Spencer announced the agenda was set. Administrative staff present: City Clerk Melissa Kellerman, City Attorney Don Bigham, Fire Chief Jim Gielow, Economic Development Coordinator Carrie Gilliam. The Pledge of Allegiance was led by Commissioner Stotlar.

PREVIOUS MINUTES

Commissioner Peradotta made a motion, which was seconded by Commissioner Kuhnert, to approve the minutes of July 10, 2023, regular council meeting. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that the ending balance total for the period ending June 2023 was $10,332,363.60 up from last year, and unrestricted balance total was $3,110,124.65 also up from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable with five additional invoice totaling $3,318.24: Companion Life $259.48, Huggins Stump Removal (Park) $460.00, Terminix $71.00, Modern Office Connections $27,76, Rice Sullivan $2,500.00. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PERRY COUNTY AG SOCIETY DONATION REQUEST

Ilene Ruroede, of the Perry County Ag Society, requested a $1,500.00 donation from the hotel/motel tax fund to be used to assist with advertising costs for the 2023 Perry County Fair. Motion by Commissioner Hicks, seconded by Commissioner Peradotta to approve the donation request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

SOUTHERN ILLINOIS CHAPTER 32 OF INTERNATIONAL HARVESTER COLLECTORS DONATION REQUEST

Drew Kocian, of the Southern Illinois Chapter 32 of International Harvester Collectors, requested a $1,000.00 donation from the hotel/motel tax fund to be used to assist with advertising and signage for their 3rd annual Cubfest in Pinckneyville September 15 & 16, 2023, at the Perry County Fairgrounds. Mr. Kocian stated they moved the event from Fredericktown, Missouri three years ago and attendees come from many surrounding states. He stated they offer free admission. Motion by Commissioner Hicks, seconded by Commissioner Kuhnert to approve the donation request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-13 AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT FOR PARTICIPATION IN THE MUTUAL AID BOX ALARM SYSTEM (MABAS MASTER AGREEMENT 2022)

Commissioner Hicks presented Ordinance No. O-2023-13, an ordinance authorizing an intergovernmental agreement for participation in the Mutual Aid Box Alarm System (MABAS Master Agreement 2022). Commissioner Hicks made a motion to approve Ordinance No. O-2023-13. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-28 AUTHORIZING THE DESTRUCTION OF AUDIO RECORDINGS OF THE CLOSED COUNCIL MEETINGS OF THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, CONDUCTED ON OR BEFORE DECEMBER 31, 2021

Commissioner Stotlar presented Resolution No. R-2023-28, a resolution authorizing the destruction of audio recordings of the closed council meetings (executive sessions) of the City of Pinckneyville, Perry County, Illinois, conducted on or before December 31, 2021. Commissioner Stotlar made a motion to approve Resolution No. R-2023-28. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-31 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO AN AGREEMENT WITH RICE SULLIVAN, LLC, FOR AUDIT SERVICES

Commissioner Stotlar introduced Resolution No. R-2023-31, a resolution to be placed on file authorizing the City of Pinckneyville, Perry County, Illinois, to enter into an agreement with Rice Sullivan, LLC, for audit services. Commissioner Stotlar made a motion to place on file Resolution No. R-2023-31. Commissioner Hicks seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-29 TO ACCEPT BID PROPOSALS FROM HAGENE EXCAVATING, LLC, FOR DEMOLITION SERVICES AT 707 BELLE AND 106 FALLON STREET

Mayor Spencer introduced Resolution No. R-2023-29, a resolution to be placed on file to accept bid proposals from Hagene Excavating, LLC, for demolition services at 707 Belle and 106 Fallon Street. Mayor Spencer these properties were acquired through the real estate tax sale. Commissioner Peradotta made a motion to place on file Resolution No. R-2023-29. Commissioner Stotlar seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-11 AUTHORIZING THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, TO ENTER INTO A SECOND AMENDMENT TO OPTION AND LEASE AGREEMENT WITH KIWI SOLAR 1, LLC

Mayor Spencer introduced Ordinance No. O-2023-11, an ordinance to be placed on file, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a second amendment to Option and Lease Agreement with Kiwi Solar 1, LLC. City Attorney Don Bigham stated there will be a $10,000 payment for the one year extension. Commissioner Stotlar made a motion to place on file Ordinance No. O-2023-11. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-30 AUTHORIZING A TAX INCREMENT FINANCING (TIF) REDEVELOPMENT AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS, AND TAPS AND VINE, LLC

Mayor Spencer introduced Resolution No. R-2023-30, a resolution to be placed on file authorizing a Tax Increment Financing (TIF) Redevelopment Agreement between the City of Pinckneyville, Perry County, Illinois, and Taps and Vine, LLC. Economic Development Coordinator Carrie Gilliam stated Carns Pizza is coming back to town at 10 North Walnut Street and Taps and Vine, LLC, will relocate all of their business under one roof at 9 West Jackson Street combining their coffee shop and wine bar into one social house for guests of all age groups. Ms. Gilliam stated this project, which will increase the restrooms from one to two at this location, is a good project for TIF Funds and State Health Department Regulations. She stated the total cost of the project is $70,000, which will include $25,000 in TIF Funds. Commissioner Peradotta made a motion to place on file Resolution No. R-2023-30. Commissioner Stotlar seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2023-32 ADOPTING THE PERRY COUNTY MULTI-HAZARD MITIGATION PLAN

Mayor Spencer presented Resolution No. R-2023-32, a resolution adopting the Perry County Multi-Hazard Mitigation Plan. Mayor Spencer stated Perry County began revising the plan five years ago, and Fire Chief Jim Gielow is on the Planning Committee. Economic Development Coordinator Carrie Gilliam stated the revisions were needed for grant applications. Commissioner Hicks made a motion to approve Resolution No. R-2023-32. Commissioner Kuhnert seconded the motion. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ORDINANCE NO. O-2023-12 APPROVING AN ADDENDUM AGREEMENT BETWEEN THE CITY OF PINCKNEYVILLE, ILLINOIS AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION REGARDING THE PROJECT FOR REALIGNMENT OF ILLINOIS STATE ROUTE 127

Mayor Spencer introduced Ordinance No. O-2023-12, an ordinance to be placed on file, approving an addendum agreement between the City of Pinckneyville, Illinois and the Illinois Department of Transportation regarding the project for realignment of Illinois State Route 127. Mayor Spencer stated the property west of the courthouse will be reverted back to the City from the State and this addendum provides for the paving on that street. Commissioner Stotlar made a motion to place on file Ordinance No. O-2023-12. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PUBLIC COMMENT

Laura Loos was present to ask about the empty lot next to her business and stated there is water running across the empty lot which is getting mud on the sidewalk in front of her building. Mayor Spencer stated the contractor was to have left the lot low enough for it to drain west, so he will talk to the contract about the issue. He also stated there are future plans for the lot.

Jeff Egbert of the Pinckneyville Press – Du Quoin Weekly requested to follow up on the progress of the banner issue in front of Taps and Vine. He stated at the last council meeting, Commissioner Hicks stated it would be handled. Mr. Egbert also stated there are two poles without banners. Mayor Spencer stated Ms. Conner has been out of town, but he has a meeting scheduled tomorrow morning and would handle the situation.
