City of Pinckneyville City Council met Aug. 26.

REGULAR MEETING OF THE PINCKNEYVILLE CITY COUNCIL

HELD MONDAY, AUGUST 26, 2024, AT 6:00 P.M. IN THE COUNCIL CHAMBERS, CITY HALL

ROLL CALL

Mayor Spencer called the regular meeting of the Pinckneyville City Council to order at 6:00 p.m. in the Council Chambers, City Hall. Members present: Commissioners Kevin B. Hicks, Joshua L. Kuhnert, Sammy D. Peradotta, William B. Stotlar, and Mayor Robert L. Spencer. Mayor Spencer declared a quorum present. Attorney Don Bigham requested to add to Executive Session for the Discussion of 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee and the Discussion of 2 (c) (6) Setting of a price for the sale or lease of property owned by a public property. Mayor Spencer then announced the agenda was set. Administrative staff present: Deputy City Clerk Terri Lindner, City Attorney Don Bigham, Economic Development Coordinator Carrie Gilliam and Fire Chief Curtis Miller. The Pledge of Allegiance was led by Commissioner Hicks.

PREVIOUS MINUTES

Commissioner Kuhnert made a motion to approve the minutes of the August 12, 2024, regular council meeting. The motion was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

TREASURER’S REPORT

Commissioner Stotlar reviewed the treasurer’s report and stated that the ending balance total for the period ending July 2024 was $10,308,271.63, up over $200,000.00 from last year, and unrestricted balance total was $2,753,163.84 down from last year. Commissioner Stotlar made a motion to approve the treasurer’s report. The motion was seconded by Commissioner Hicks. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ACCOUNTS PAYABLE

Commissioner Stotlar made a motion to approve the accounts payable. The motion was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

CORRESPONDENCE

Commissioner Hicks noted the American Thresherman’s Show was a great success. Bob Giacomo, who is a member of the American Thresherman Show was in the crowd. Commissioner Hicks asked how the numbers were. He stated that there were 1275 pieces of equipment registered, biggest they have ever had. He also stated that there was a gentleman from Germany that attended the show and that he was eager to return for next years show.

BID OPENINGS FOR 705 S. DOUGLAS AND 701 DUCKWORTH

City Attorney Don Bigham opened the two bids that were received for 705 S. Douglas Street and 701 Duckworth Street. The first bid envelope opened was from Sophia Ogilvie. Her bid was $5,000.00 for 701 Duckworth Street. The second bid envelope opened was from Brian Scronce. His bid was $2,250.00. Attorney Don Bigham stated that these bids were good for 45 days.

REQUEST FROM PINCKNEYVILLE CHAMBER OF COMMERCE TO DISCUSS ASSISTANCE WITH MARDI GRAS ADVERTISING FUNDS AND STREET CLOSURES RELATED TO ALL MARDI GRAS EVENTS

Betti Mucha, President, and Dana Carney, Executive Director, of Pinckneyville Chamber of Commerce, requested $1,500.00 from the Hotel/Motel Fund to assist with advertising; street closures for the Children’s Parade, Business Trick-or-Treat, Vendor Fair and use of City Hall parking lot, and Night Parade (closing streets at 6 p.m.); traffic control and clean-up. Executive Director Dana Carney also requested use of the lamp posts for the lamp post decorating competition. Mayor Spencer stated that yes, they are available to use. Commissioner Hicks made a motion to approve their requests, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PINCKNEYVILLE COMMUNITY HIGH SCHOOL REQUEST TO HOLD HOMECOMING PARADE SEPTEMBER 27, 2024

Commissioner Hicks presented a request from Pinckneyville Community High School to hold a homecoming parade on Friday, September 27, 2024, at 2:00 p.m., following their usual parade route. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST FROM PINCKNEYVILLE KNIGHTS OF COLUMBUS TO COLLECT AT 4-WAY STOP ON OCTOBER 26, 2024

Commissioner Hicks read a request from the Pinckneyville Knights of Columbus to collect at the 4-way stop on Saturday, October 26, 2024, from 7:00 a.m. to 3:00 p.m. for benefit of Pinckneyville District #50 and Special Olympics. Bob Giacomo stated that they would only be standing on the east and west stop signs at the 4-way. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

REQUEST FROM TAPS AND VINE TO USE CITY PARKING LOT FOR “TOUCH A TRUCK” EVENT ON OCTOBER 19, 2024

Commissioner Hicks read a request from Taps and Vine, LLC requesting the use of the City’s parking lot west of their location at 9 W. Jackson Street for a “Touch the Truck” event on October 19, 2024. Lauren Moore, owner, stated that they are having a fire truck, bucket truck, ambulance, ARCH helicopter and other miscellaneous pieces of equipment for everyone to explore. She stated that this is a free event. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

FIREFIGHTERS OFFICER POSITIONS WITHIN PINCKNEYVILLE FIRE DEPARTMENT

Commissioner Hicks requested approval to promote Zack Kelly and Andrew Lipe as Lieutenants for the Pinckneyville Fire Department. Commissioner Hicks made a motion to approve the request, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

APPROVAL TO HIRE ONE PART-TIME EMPLOYEE FOR MOWING AND TRIMMING AT THE CITY PARK

Commissioner Kuhnert requested approval to hire one part-time employee for mowing and trimming at the City Park. Motion by Commissioner Kuhnert, seconded by Commissioner Peradotta to approve the request. On roll call: Commissioners Hicks, Kuhnert, Peradotta, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

HIRE WASTEWATER OPERATOR

Commissioner Kuhnert tabled the requested to hire recommended applicant for the Wastewater Operator position.

RESOLUTION NO. R-2024-39 TO ACCEPT QUOTE FROM CDS TECHNOLOGIES TO REPLACE NETWORK SERVER AND PHONE SYSTEM

Commissioner Stotlar presented Resolution No. R-2024-39, a resolution to be placed on file, to accept quote from CDS Technologies to replace network server and provide upgrades and management services for computer and phone systems. Commissioner Stotlar explained that the phones the city are currently using are going to have to be replaced by next year and that the server has been failing. He further explained that when it was all said and done there will be a savings to the city with the new systems annually with also a better cyber security enhancement. Commissioner Stotlar made a motion to place on file Resolution No. R-2024-39, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-36 TO ACCEPT A BID PROPOSAL FROM EMPIRE EARTH & CONCRETE COMPANY TO REMOVE AND REPLACE DAMAGED SIDEWALK AT 710 SOUTH MAIN STREET, PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Mayor Spencer introduced Resolution No. R-2024-36, a resolution placed on file at the August 12, 2024 regular council meeting, to accept a bid proposal from Empire Earth & Concrete Company to remove and replace damaged sidewalk at 710 South Main Street, Pinckneyville, Perry County, Illinois. Commissioner Hicks made a motion to approve Resolution No. R 2024-36, which was seconded by Commissioner Kuhnert. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-37 TO ACCEPT A BID PROPOSAL FROM GREENRIDGE LANDSCAPING SERVICES TO IMPROVE VISIBILITY AT THE INTERSECTION OF NORTH MAIN STREET AND LAUREL STREET IN THE CITY OF PINCKNEYVILLE, PERRY COUNTY, ILLINOIS

Mayor Spencer introduced Resolution No. R-2024-37, a resolution placed on file at the August 12, 2024 regular council meeting, to accept a bid proposal from Greenridge Landscaping Services to improve visibility at the intersection of North Main Street and Laurel Street in the City of Pinckneyville, Perry County, Illinois. Commissioner Peradotta made a motion to approve Resolution No. R-2024-37, which was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RESOLUTION NO. R-2024-38 TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT WITH THE LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA, THE DOWNSTATE LABORERS’ DISTRICT COUNCIL, AND LABORERS’ LOCAL 773

Mayor Spencer introduced Resolution No. R-2024-38, a resolution placed on file at the August 12, 2024 regular council meeting, to enter into a Collective Bargaining Agreement with the Laborers’ International Union of North America, the Downstate Laborers’ District Council, and Laborers’ Local 773. Commissioner Kuhnert made a motion to approve Resolution No. R-2024-38, which was seconded by Commissioner Stotlar. On roll call: Commissioners Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: Commissioner Hicks. Motion declared carried.

ORDINANCE NO. O-2024-09 TO ENTER INTO A FIRST AMENDMENT TO AMENDED AND RESTATED OPTION AND LEASE AGREEMENT (SOUTH) WITH KIWI SOLAR 2, LLC

Mayor Spencer introduced Ordinance No. O-2024-09, an ordinance placed on file at the August 12, 2024 regular council meeting, authorizing the City of Pinckneyville, Perry County, Illinois, to enter into a first amendment to amended and restated option and lease agreement (south) with Kiwi Solar 2, LLC. Commissioner Hicks made a motion to approve Ordinance No. O 2024-09, which was seconded by Commissioner Peradotta. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PINCKNEYVILLE GARDEN CLUB REQEUST APPROVAL OF BLUE & GOLD STAR MONUMENTS

Sandy Sweeney, April Welch, and Karen Heisner, of the Pinckneyville Garden Club requests approval of placing a Blue Star Memorial Marker in the City Park along the walking path. Sandy Sweeney stated that they ideally would like it placed in close proximity to the existing Veterans Memorial that was dedicated by Tyler Wildermuth while completing his Eagle Scout requirement. They have reached out to him for his blessing which he did give. Sandy went on to say that the Garden Club has received a generous donation to go towards the monument and will continue to have fundraisers to complete the purchase and installation of the monument. She also stated that their goal is to continue to raise funds to be able to put a Gold Star Memorial Marker in the same location as well. Commissioner Kuhnert made a motion to approve the placing of a Blue Star Memorial Marder at the City Park. The motion was seconded by Commissioner Stotlar. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

PUBLIC COMMENT

Jeff Egbert of the Weekly Press asked where the helicopter was going to land for the “Touch the Truck” event the Taps and Vine was holding. Lauren Moore stated that they were still working out the details. A few commissioners stated that the empty grass lot would be an ideal spot.

ADJOURNMENT TO EXECUTIVE SESSION

Motion by Commissioner Peradotta, seconded by Commissioner Stotlar to move the meeting to Executive Session at 6:25 p.m. for the discussion of: Section 2 (c) (1) Appointment, employment, compensation, discipline, performance, or dismissal of an employee, Section 2 (c) (6) Setting of a price for the sale or lease of property owned by the public property owned by the public body, and Section 2 (c) (11) Litigation, pending or probable. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

RETURN TO REGULAR MEETING

Motion by Commissioner Peradotta, seconded by Commissioner Kuhnert to return to the regular meeting at 7:10 p.m. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.

ADJOURNMENT

Motion by Commissioner Stotlar, seconded by Commissioner Kuhnert to adjourn the meeting at 7:11 p.m. On roll call: Commissioners Hicks, Kuhnert, Peradotta, Stotlar, and Mayor Spencer voted YEA. NAYS: None. Motion declared carried.
